Regard To Reputation Has A Less Active Influence, When The Infamy Of A Bad Action Is To Be Divided Among A Number Than When It Is To Fall Singly Upon One.

Let Experience, The Least Fallible Guide Of Human Opinion, Be Appealed To For An Answer To These Inquiries.

But The Greatest Obstacle Of All To The Successful Prosecution Of A New Branch Of Industry In A Country, In Which It Was Before Unknown, Consists . . . It Might Be Demonstrated That The Most Productive System Of Finance Will Always Be The Least Burdensome.

A Republic Of This Kind, Able To Withstand An External Force, May Support Itself Without Any Internal Corruptions. The Form Of This Society Prevents All Manner Of Inconveniences.

I Trust That The Proposed Constitution Afford A Genuine Specimen Of Representative Government And Republican Government; And That It Will Answer, In An Eminent Degree, All The Beneficial Purposes Of Society.

Safety From External Danger Is The Most Powerful Director Of National Conduct. Even The Ardent Love Of Liberty Will, After A Time, Give Way To Its Dictates. The Violent Destruction Of Life And Property Incident To War, The Continual Effort And Alarm Attendant On A State Of Continual Danger, Will Compel Nations The Most Attached To Liberty To Resort For Repose And Security To Institutions Which Have A Tendency To Destroy Their Civil And Political Rights. To Be More Safe, They At Length Become Willing To Run The Risk Of Being Less Free.

When You Assemble From Your Several Counties In The Legislature, Were Every Member To Be Guided Only By The Apparent Interest Of His County, Government Would Be Impracticable. There Must Be A Perpetual Accomodation And Sacrifice Of Local Advantage To General Expediency.

The Voice Of The People Has Been Said To Be The Voice Of God; And, However Generally This Maxim Has Been Quoted And Believed, It Is Not True To Fact. The People Are Turbulent And Changing, They Seldom Judge Or Determine Right.

We Are Attempting, By This Constitution, To Abolish Factions, And To Unite All Parties For The General Welfare.

In The Usual Progress Of Things, The Necessities Of A Nation In Every Stage Of Its Existence Will Be Found At Least Equal To Its Resources.

I Propose . . . . The Conformity Of The Proposed Constitution To The True Principles Of Republican Government.

If It Be Asked What Is To Restrain The House Of Representatives From Making Legal Discriminations In Favor Of Themselves And A Particular Class Of The Society? I Answer, The Genius Of The Whole System, The Nature Of Just And Constitutional Laws, And Above All The Vigilant And Manly Spirit Which Actuates The People Of America, A Spirit Which Nourishes Freedom, And In Return Is Nourished By It. If This Spirit Shall Ever Be So Far Debased As To Tolerate A Law Not Obligatory On The Legislature As Well As On The People, The People Will Be Prepared To Tolerate Anything But Liberty.

The People Alone Have An Incontestable, Unalienable, And Indefeasible Right To Institute Government And To Reform, Alter, Or Totally Change The Same When Their Protection, Safety, Prosperity, And Happiness Require It.

Would There Not Be The Greatest Reason To Apprehend, That Error In The First Sentence Would Be The Parent Of Error In The Second Sentence? Every Nation Ought To Have A Right To Provide For Its Own Happiness.

The History Of Human Conduct Does Not Warrant That Exalted Opinion Of Human Virtue Which Would Make It Wise In A Nation To Commit Interests Of So Delicate And Momentous A Kind As Those Which Concern Its Intercourse With The Rest Of The World, To The Sole Disposal Of A Magistrate, Created And Circumstanced, As Would Be A President Of The United States.

Nor Does The Evil End Here; The Same Disadvantage Must Be Sustained Upon Whatever Is To Be Bought On Terms Of Future Payment. From This Constant Necessity Of Borrowing And Buying Dear, It Is Easy To Conceive How Immensely The Expenses Of A Nation, In A Course Of Time, Will Be Augmented By An Unsound State Of The Public Credit.

The Local Interest Of A State Ought In Every Case To Give Way To The Interests Of The Union. For When A Sacrifice Of One Or The Other Is Necessary, The Former Becomes Only An Apparent, Partial Interest, And Should Yield, On The Principle That The Smaller Good Ought Never To Oppose The Greater Good.

Nothing Could Be More Ill-judged Than That Intolerant Spirit Which Has, At All Times, Characterized Political Parties.

Unless Your Government Is Respectable, Foreigners Will Invade Your Rights; And To Maintain Tranquillity You Must Be Respectable; Even To Observe Neutrality You Must Have A Strong Government.

I Never Expect To See A Perfect Work From An Imperfect Man.

The Great Leading Objects Of The Federal Government, In Which Revenue Is Concerned, Are To Maintain Domestic Peace, And Provide For The Common Defense.

When The Sword Is Once Drawn, The Passions Of Men Observe No Bounds Of Moderation.

It Is A Singular Advantage Of Taxes On Articles Of Consumption That They Contain In Their Own Nature A Security Against Excess. They Prescribe Their Own Limit, Which Cannot Be Exceeded Without Defeating The End Purposed - That Is, An Extension Of The Revenue.

It Is One Thing To Be Subordinate To The Laws, And Another [for The Executive] To Be Dependent On The Legislative Body. The First Comports With, The Last Violates, The Fundamental Principles Of Good Government; And, Whatever May Be The Forms Of The Constitution, Unites All Power In The Same Hands.

The States Have Authority To Interpret The Constitution, Enforce It, And Protect The People From Violations Of It By The Federal Government In The First Place, There Is Not A Syllable In The Plan Under Consideration Which Directly Empowers The National Courts To Construe The Laws According To The Spirit Of The Constitution, Or Which Gives Them Any Greater Latitude In This Respect Than May Be Claimed By The Courts Of Every State.

The Same Rule That Teaches The Propriety Of A Partition Between The Various Branches Of Power, Teaches Us Likewise That This Partition Ought To Be So Contrived As To Render The One Independent Of The Other.

It Is Presumable That No Country Will Be Able To Borrow Of Foreigners Upon Better Terms Than The United States, Because None Can, Perhaps, Afford So Good Security.

That This Gentleman [president John Adams] Ought Not To Be The Object Of The Federal Wish, Is, With Me, Reduced To Demonstration. His Administration Has Already Very Materially Disgraced And Sunk The Government. There Are Defects In His Character Which Must Inevitably Continue To Do This More And More. Were Not The Disadvantages Of Slavery Too Obvious To Stand In Need Of It, I Might Enumerate And Describe The Tedious Train Of Calamities Inseparable From It. I Might Show That It Is Fatal To Religion And Morality; That It Tends To Debase The Mind, And Corrupt Its Noblest Springs Of Action. I Might Show That It Relaxes The Sinews Of Industry, Clips The Wings Of Commerce, And Introduces Misery And Indigence In Every Shape.

Let Us Recollect That Peace Or War Will Not Always Be Left To Our Option; That However Moderate Or Unambitious We May Be, We Cannot Count Upon The Moderation, Or Hope To Extinguish The Ambition Of Others.

In A Free Government, The Security For Civil Rights Must Be The Same As That For Religious Rights. It Consists In The One Case In The Multiplicity Of Interests, And In The Other In The Multiplicity Of Sects.

The Injury Which May Possibly Be Done By Defeating A Few Good Laws, Will Be Amply Compensated By The Advantage Of Preventing A Number Of Bad Ones.

It Is Astonishing That So Simple A Truth Should Ever Have Had An Adversary; And It Is One Among A Multitude Of Proofs, How Apt A Spirit Of Ill-informed Jealousy, Or Of Too Great Abstraction And Refinement Is To Lead Men Astray From The Plainest Paths Of Reason And Conviction.

The Origin Of All Civil Government, Justly Established, Must Be A Voluntary Compact, Between The Rulers And The Ruled; And Must Be Liable To Such Limitations, As Are Necessary For The Security Of The Absolute Rights Of The Latter; For What Original Title Can Any Man Or Set Of Men Have, To Govern Others, Except Their Own Consent?

And It Proves, In The Last Place, That As Liberty Can Have Nothing To Fear From The Judiciary Alone, But Would Have Every Thing To Fear From Its Union With Either Of The Other Departments.

Is It Not Time To Awake From The Deceitful Dream Of A Golden Age, And To Adopt As A Practical Maxim For The Direction Of Our Political Conduct, That We, As Well As The Other Inhabitants Of The Globe, Are Yet Remote From The Happy Empire Of Perfect Wisdom And Perfect Virtue?

That Americans Are Entitled To Freedom Is Incontestable On Every Rational Principle. All Men Have One Common Original: They Participate In One Common Nature, And Consequently Have One Common Right. No Reason Can Be Assigned Why One Man Should Exercise Any Power Or Preeminence Over His Fellow-creatures More Than Another; Unless They Have Voluntarily Vested Him With It.

The Legislatures Will Have Better Means Of Information. They Can Discover The Danger At A Distance; And Possessing All The Organs Of Civil Power, And The Confidence Of The People, They Can At Once Adopt A Regular Plan Of Opposition, In Which They Can Combine All The Resources Of The Community. They Can Readily Communicate With Each Other In The Different States, And Unite Their Common Forces For The Protection Of Their Common Liberty.

To Answer The Purpose Of The Adversaries Of The Constitution, They Ought To Prove, Not Merely That Particular Provisions In It Are Not The Best, Which Might Have Been Imagined; But That The Plan Upon The Whole Is Bad And Pernicious.

A Share In The Sovereignty Of The State, Which Is Exercised By The Citizens At Large, In Voting At Elections Is One Of The Most Important Rights Of The Subject, And In A Republic Ought To Stand Foremost In The Estimation Of The Law...that Portion Of The Sovereignty, To Which Each Individual Is Entitled, Can Never Be Too Highly Prized. It Is That For Which We Have Fought And Bled.

Industry Is Increased, Commodities Are Multiplied, Agriculture And Manufacturers Flourish: And Herein Consists The True Wealth And Prosperity Of A State.

A Sacred Respect For The Constitutional Law Is The Vital Principle, The Sustaining Energy Of A Free Government.

There Is Something So Far-fetched And So Extravagant In The Idea Of Danger To Liberty From The Militia That One Is At A Loss Whether To Treat It With Gravity Or With Raillery; Whether To Consider It As A Mere Trial Of Skill, Like The Paradoxes Of Rhetoricians; As A Disingenuous Artifice To Instil Prejudices At Any Price; Or As The Serious.

A Government Ought To Contain In Itself Every Power Requisite To The Full Accomplishment Of The Objects Committed To Its Care, And To The Complete Execution Of The Trusts For Which It Is Responsible, Free From Every Other Control But A Regard To The Public Good And To The Sense Of The People.

It Is Impossible Not To Bestow The Imputation Of Deliberate Imposture And Deception Upon The Gross Pretense Of A Similitude Between A King Of Great Britain And A Magistrate Of The Character Marked Out For That Of The President Of The United States. It Is Still More Impossible To Withhold That Imputation From The Rash And Barefaced Expedients Which Have Been Employed To Give Success To The Attempted Imposition.

The Practice Of Arbitrary Imprisonments Have Been, In All Ages, The Favorite And Most Formidable Instruments Of Tyranny.

A Fondness For Power Is Implanted In Most Men, And It Is Natural To Abuse It When Acquired. This Maxim, Drawn From The Experience Of All Ages, Makes It The Height Of Folly To Intrust Any Set Of Men With Power Which Is Not Under Every Possible Control; Perpetual Strides Are Made After More As Long As There Is Any Part Withheld.

When Human Laws Contradict Or Discountenance The Means, Which Are Necessary To Preserve The Essential Rights Of Any Society, They Defeat The Proper End Of All Laws, And So Become Null And Void.

A Treaty Cannot Be Made Which Alters The Constitution Of The Country, Or Which Infringes And Express Exceptions To The Power Of The Constitution.

It Is Of The Greatest Consequence That The Debt Should, With The Consent Of The Creditors, Be Remoulded Into Such A Shape As Will Bring The Expenditure Of The Nation To A Level With Its Income. Till This Shall Be Accomplished, The Finances Of The United States Will Never Wear A Proper Countenance. Arrears Of Interest, Continually Accruing, Will Be As Continual A Monument, Either Of Inability, Or Of Ill Faith And Will Not Cease To Have An Evil Influence On Public Credit.

It Is Far More Rational To Suppose That The Courts Were Designed To Be An Intermediate Body Between The People And The Legislature, In Order, Among Other Things, To Keep The Latter Within The Limits Assigned To Their Authority.

Passive Commerce . . . Should Thus . . . [compel Us] To Content Ourselves With The First Price Of Our Commodities, And To See The Profits Of Our Trade Snatched From Us, To Enrich Our Enemies And Persecutors. There Is A Certain Enthusiasm In Liberty, That Makes Human Nature Rise Above Itself, In Acts Of Bravery And Heroism.

The Natural Cure For An Ill-administration, In A Popular Or Representative Constitution, Is A Change Of Men.

The Experience Of Treaties Being Broken With Impunity Provide An Afflicting Lesson To Mankind How Little Dependence Is To Be Placed On Treaties Which Have No Other Sanction Than The Obligations Of Good Faith; And Which Oppose General Considerations Of Peace And Justice To The Impulse Of Any Immediate Interest And Passion.

Wise Politicians Will Be Cautious About Fettering The Government With Restrictions That Cannot Be Observed, Because They Know That Every Break Of The Fundamental Laws, Though Dictated By Necessity, Impairs That Sacred Reverence Which Ought To Be Maintained In The Breast Of Rulers Towards The Constitution Of A Country.

To Look For A Continuation In Harmony Between A Number Of Independent Unconnected Sovereignties, Situated In The Same Neighborhood, Would Be To Disregard The Uniform Course Of Human Events, And To Set At Defiance The Accumulated Experience Of Ages.

In The General Course Of Human Nature, A Power Over A Man's Subsistence Amounts To A Power Over His Will.

You Should Not Have Taken Advantage Of My Sensibility To Steal Into My Affections Without My Consent.

Through The Opposition And Mutual Control Of These Bodies, The Government Will Reach, In Its Regular Operations, The Perfect Balance Between Liberty And Power.

[w]ar Is A Question, Under Our Constitution, Not Of Executive, But Of Legislative Cognizance. It Belongs To Congress To Say Whether The Nation Shall Of Choice Dismiss The Olive Branch And Unfurl The Banners Of War.

If, Then, The Courts Of Justice Are To Be Considered As The Bulwarks Of A Limited Constitution Against Legislative Encroachments, This Consideration Will Afford A Strong Argument For The Permanent Tenure Of Judicial Offices, Since Nothing Will Contribute So Much As This To That Independent Spirit In The Judges Which Must Be Essential To The Faithful Performance Of So Arduous A Duty.

There Are Men Who Could Neither Be Distressed Nor Won Into A Sacrifice Of Their Duty; But This Stern Virtue Is The Growth Of Few Soils: And In The Main It Will Be Found, That A Power Over A Man's Support Is A Power Over His Will.
