The Operations Of The Federal Government Will Be Most Extensive And Important In Times Of War And Danger; Those Of The State Governments, In Times Of Peace And Security.

Some Degree Of Abuse Is Inseparable From The Proper Use Of Every Thing; And In No Instance Is This More True Than In That Of The Press. It Has Accordingly Been Decided, By The Practice Of The States, That It Is Better To Leave A Few Of Its Noxious Branches To Their Luxuriant Growth, Than, By Pruning Them Away, To Injure The Vigor Of Those Yielding The Proper Fruits.

It May Not Be Easy, In Every Possible Case, To Trace The Line Of Separation Between The Rights Of Religion And The Civil Authority With Such Distinctness As To Avoid Collisions And Doubts On Unessential Points. The Tendency To Unsurpastion On One Side Or The Other, Or To A Corrupting Coalition Or Alliance Between Them, Will Be Best Guarded Agst. By An Entire Abstinence Of The Gov't From Interfence In Any Way Whatsoever, Beyond The Necessity Of Preserving Public Order, And Protecting Each Sect Agst. Trespasses On Its Legal Rights By Others.

Among The Features Peculiar To The Political System Of The United States, Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect.

In The Compound Republic Of America, The Power Surrendered By The People Is First Divided Between Two Distinct Governments, And Then The Portion Allotted To Each Subdivided Among Distinct And Separate Governments. Hence A Double Security Arises To The Rights Of The People. The Different Governments Will Control Each Other, At The Same Time That Each Will Be Controlled By Itself.

There Is Not A More Important And Fundamental Principle In Legislation, Than That The Ways And Means Ought Always To Face The Public Engagements; That Our Appropriations Should Ever Go Hand In Hand With Our Promises.

The Capacity Of The Female Mind For Studies Of The Highest Order Cannot Be Doubted, Having Been Sufficiently Illustrated By Its Works Of Genius, Of Erudition, And Of Science.

Theoretic Politicians, Who Have Patronized This Species Of Government, Have Erroneously Supposed That By Reducing Mankind To A Perfect Equality In Their Political Rights, They Would, At The Same Time, Be Perfectly Equalized And Assimilated In Their Possessions, Their Opinions, And Their Passions.

Democracies Have

A Standing Military Force, With An Overgrown Executive Will Not Long Be Safe Companions To Liberty.

Besides The Obscurity Arising From The Complexity Of Objects, And The Imperfection Of The Human Faculties, The Medium Through Which The Conceptions Of Men Are Conveyed To Each Other Adds A Fresh Embarrassment.

People Will Continue To Seek Justice Until It Is Found, Or Until Liberty Is Lost In The Pursuit.

Because The Bill Vests In The Said Incorporated Church An Authority To Provide For The Support Of The Poor And The Education Of Poor Children Of The Same, An Authority Which, Being Altogether Superfluous If The Provision Is To Be The Result Of Pious Charity, Would Be A Precedent For Giving To Religious Societies As Such A Legal Agency In Carrying Into Effect A Public And Civil Duty.

The Problem To Be Solved Is, Not What Form Of Government Is Perfect, But Which Of The Forms Is Least Imperfect.

Having Outlived So Many Of My Contemporaries, I Ought Not To Forget That I May Be Thought To Have Outlived Myself.

Happily For The States, They Enjoy The Utmost Freedom Of Religion. This Freedom Arises From That Multiplicity Of Sects Which Pervades America, And Which Is The Best And Only Security For Religious Liberty In Any Society.

Philosophy Is Common Sense With Big Words.

By A Faction, I Understand A Number Of Citizens, Whether Amounting To A Majority Or A Minority Of The Whole, Who Are United And Actuated By Some Common Impulse Of Passion, Or Of Interest... The Latent Causes Of Faction Are Sown In The Nature Of Man.

[a]ll Power Is Originally Vested In, And Consequently Derived From, The People. That Government Is Instituted And Ought To Be Exercised For The Benefit Of The People; Which Consists In The Enjoyment Of Life And Liberty And The Right Of Acquiring Property, And Generally Of Pursuing And Obtaining Happiness And Safety. That The People Have An Indubitable, Unalienable, And Indefeasible Right To Reform Or Change Their Government Whenever It Be Found Adverse Or Inadequate To The Purpose Of Its Institution.

The People Can Never Willfully Betray Their Own Interests: But They May Possibly Be Betrayed By The Representatives Of The People; And The Danger Will Be Evidently Greater Where The Whole Legislative Trust Is Lodged In The Hands Of One Body Of Men, Than Where The Concurrence Of Separate And Dissimilar Bodies Is Required In Every Public Act.

No Free Country Has Ever Been Without Parties, Which Are A Natural Offspring Of Freedom.

The Government Of The United States Is A Definite Government, Confined To Specified Objects. It Is Not Like The State Governments, Whose Powers Are More General. Charity Is No Part Of The Legislative Duty Of The Government.

Union Of Religious Sentiments Begets A Surprising Confidence.

In This Relation, Then, The Proposed Government Cannot Be Deemed A National One; Since Its Jurisdiction Extends To Certain Enumerated Objects Only, And Leaves To The Several States, A Residuary And Inviolable Sovereignty Over All Other Objects.

In Republics, The Great Danger Is, That The Majority May Not Sufficiently Respect The Rights Of The Minority.

Every Nation Whose Affairs Betray A Want Of Wisdom And Stability May Calculate On Every Loss Which Can Be Sustained From The More Systematic Policy Of Its Wiser Neighbors.

At Cheaper And Nearer Seats Of Learning Parents With Slender Incomes May Place Their Sons In A Course Of Education Putting Them On A Level With The Sons Of The Richest.

If We Are To Take For The Criterion Of Truth The Majority Of Suffrages, They Ought To Be Gotten From Those Philosophic And Patriotic Citizens Who Cultivate Their Reason.

But The Most Deplorable Effect Of All, Is That Diminution Of Attachment And Reverence, Which Steals Into The Hearts Of The People, Towards A Political System Which Betrays So Many Marks Of Infirmity, And Disappoints So Many Of Their Flattering Hopes. The Apportionment Of Taxes On The Various Descriptions Of Property Is An Act Which Seems To Require The Most Exact Impartiality; Yet There Is, Perhaps, No Legislative Act In Which Greater Opportunity And Temptation Are Given To A Predominant Party To Trample On The Rules Of Justice. Every Shilling Which They Overburden The Inferior Number Is A Shilling Saved To Their Own Pockets.

It Is Vain To Say That Enlightened Statesmen Will Always Be Able To Adjust Their Interests. Enlightened Men Will Not Always Be At The Helm.

The Constitution Expressly And Exclusively Vests In The Legislature The Power Of Declaring A State Of War [and] The Power Of Raising Armies.... War Is In Fact The True Nurse Of Executive Aggrandizement

As Long As The Reason Of Man Continues Fallible, And He Is At Liberty To Exercise It, Different Opinions Will Be Formed. As Long As The Connection Subsists Between His Reason And His Self-love, His Opinions And Passions Will Have A Reciprocal Influence On Each Other, And The Former Will Be Objects To Which The Latter Attach Themselves.

Attempts To Enforce By Legal Sanctions, Acts Obnoxious To So Great A Proportion Of Citizens, Tend To Enervate The Laws In General, And To Slacken The Bands Of Society. If It Be Difficult To Execute Any Law Which Is Not Generally Deemed Necessary Or Salutary, What Must Be The Case, Where It Is Deemed Invalid And Dangerous? And What May Be The Effect Of So Striking An Example Of Impotency In The Government, On Its General Authority?

It May Well Happen That The Public Voice, Pronounced By The Representatives Of The People, Will Be More Constant To The Public Good Than If Pronounced By The People Themselves.

Man Is Known To Be A Selfish, As Well As A Social Being.

In All The Co-temporary Discussions And Comments, Which The Constitution Underwent, It Was Constantly Justified And Recommended On The Ground, That The Powers Not Given To The Government, Were Withheld From It.

In War, Too, The Discretionary Power Of The Executive Is Extended; Its Influence In Dealing Out Offices, Honors, And Emoluments Is Multiplied; And All The Meaning Of Seducing The Minds, Are Added To Those Of Subduing The Force, Of The People. The Same Malignant Aspect In Republicanism May Be Traced In The Inequality Of Fortunes, And The Opportunities Of Fraud, Growing Out Of A State Of War, And In The Degeneracy Of Manners And Morals, Engendered By Both. No Nation Could Preserve Its Freedom In The Midst Of Continual Warfare.

Each State, In Ratifying The Constitution, Is Considered As A Sovereign Body, Independent Of All Others, And Only To Be Bound By Its Own Voluntary Act. In This Relation, Then, The New Constitution Will, If Established, Be A Federal, And Not A National Constitution.

In Suits At Common Law, Trial By Jury In Civil Cases Is As Essential To Secure The Liberty Of The People As Any One Of The Pre-existent Rights Of Nature.

What Is Here A Right Towards Men, Is A Duty Towards The Creator.

But Cool And Candid People Will At Once Reflect, That The Purest Of Human Blessings Must Have A Portion Of Alloy In Them, That The Choice Must Always Be Made, If Not Of The Lesser Evil, At Least Of The Greater, Not The Perfect Good; And That In Every Political Institution, A Power To Advance The Public Happiness, Involves A Discretion Which May Be Misapplied And Abused.

A Just Security To Property Is Not Afforded By That Government, Under Which Unequal Taxes Oppress One Species Of Property And Reward Another Species.

So Strong Is This Propensity Of Mankind To Fall Into Mutual Animosities, That Where No Substantial Occasion Presents Itself, The Most Frivolous And Fanciful Distinctions Have Been Sufficient To Kindle Their Unfriendly Passions And Excite Their Most Violent Conflicts. But The Most Common And Durable Source Of Factions Has Been The Various And Unequal Distribution Of Property.

It Overflows, By Emigration, To Places Where A Surplus Of Food Is Attainable.

[a] Mere Demarcation On Parchment Of The Constitutional Limits Of The Several Departments Is Not A Sufficient Guard Against Those Encroachments Which Lead To A Tyrannical Concentration Of All The Powers Of Government In The Same Hands.

To Refer The Power In Question To The Clause "to Provide For The Common Defense And General Welfare" Would Be Contrary To The Established And Consistent Rules Of Interpretation, As Rendering The Special And Careful Enumeration Of Powers Which Follow The Clause Nugatory And Improper. Such A View Of The Constitution Would Have The Effect Of Giving To Congress A General Power Of Legislation Instead Of The Defined And Limited One Hitherto Understood To Belong To Them, The Terms "common Defense And General Welfare" Embracing Every Object And Act Within The Purview Of A Legislative Trust.

The Rich Man, When Contributing To A Permanent Plan For The Education Of The Poor, Ought To Reflect That He Is Providing For That Of His Own Descendants; And The Poor Man Who Concurs In A Provision For Those Who Are Not Poor That At No Distant Day It May Be Enjoyed By Descendants From Himself. It Does Not Require A Long Life To Witness These Vicissitudes Of Fortune.

The People Are The Only Legitimate Fountain Of Power, And It Is From Them That The Constitutional Charter, Under Which The Several Branches Of Government Hold Their Power, Is Derived.

Every Word Of [the Constitution] Decides A Question Between Power And Liberty.

The First Question That Offers Itself Is, Whether The General Form And Aspect Of The Government Be Strictly Republican? It Is Evident That No Other Form Would Be Reconcileable With The Genius Of The People Of America; With The Fundamental Principles Of The Revolution; Or With That Honourable Determination Which Animates Every Votary Of Freedom, To Rest All Our Political Experiments On The Capacity Of Mankind For Self-government.

A Certain Degree Of Preparation For War . . . Affords Also The Best Security For The Continuance Of Peace.

The Smaller The Number And The More Permanent And Conspicuous The Station Of Men In Power, The Stronger Must Be The Interest Which They Will Individually Feel In Whatever Concerns The Government.

It Is Impossible For The Man Of Pious Reflection Not To Perceive In It [the Constitution] A Finger Of That Almighty Hand Which Has Been So Frequently And Signally Extended To Our Relief In The Critical Stages Of The Revolution.

The Important Distinction So Well Understood In America Between A Constitution Established By The People, And Unalterable By The Government; And A Law Established By The Government, And Alterable By The Government, Seems To Have Been Little Understood And Less Observed In Any Other Country. Wherever The Supreme Power Of Legislation Has Resided, Has Been Supposed To Reside Also, A Full Power To Change The Form Of Government.

In A Free Government, The Security For Civil Rights Must Be The Same As That For Religious Rights. It Consists In The One Case In The Multiplicity Of Interests, And In The Other In The Multiplicity Of Sects. The Degree Of Security In Both Cases, Will Depend On The Number Of Interests And Sects; And This May Be Presumed To Depend On The Extent Of Country And Number Of People Comprehended Under The Same Government.

Whatever May Be The Judgement Pronounced On The Competency Of The Architects Of The Constitution, Or Whatever May Be The Destiny Of The Edifice Prepared By Them, I Feel It A Duty To Express My Profound And Solemn Conviction . . . That There Never Was An Assembly Of Men, Charged With A Great And Arduous Trust, Who Were More Pure In Their Motives, Or More Exclusively Or Anxiously Devoted To The Object Committed To Them.

The People Shall Not Be Deprived Or Abridged Of Their Right To Speak, Or To Publish Their Sentiments; And The Freedom Of The Press, As One Of The Great Bulwarks Of Liberty, Shall Be Inviolable.

If Our Nation Is Ever Taken Over, It Will Be Taken Over From Within.

The Future And Success Of America Is Not In This Constitution, But In The Laws Of God Upon Which This Constitution Is Founded.

It May Be Considered As An Objection Inherent In The Principle, That As Every Appeal To The People Would Carry An Implication Of Some Defect In The Government, Frequent Appeals Would In Great Measure Deprive The Government Of That Veneration Which Time Bestows On Every Thing, And Without Which Perhaps The Wisest And Freest Governments Would Not Possess The Requisite Stability . . . A Constitutional Road To The Decision Of The People Ought To Be Marked Out And Kept Open, For Certain Great And Extraordinary Occasions

Because The Bill In Reserving A Certain Parcel Of Land In The United States For The Use Of Said Baptist Church Comprises A Principle And A Precedent For The Appropriation Of Funds Of The United States For The Use And Support Of Religious Societies, Contrary To The Article Of The Constitution Which Declares That "congress Shall Make No Law Respecting A Religious Establishment."

If Men Were Angels, No Government Would Be Necessary. If Angels Were To Govern Men, Neither External Nor Internal Controls On Government Would Be Necessary. In Framing A Government Which Is To Be Administered By Men Over Men, The Great Difficulty Lies In This: You Must First Enable The Government To Control The Governed; And In The Next Place Oblige It To Control Itself. A Dependence On The People Is, No Doubt, The Primary Control On The Government; But Experience Has Taught Mankind The Necessity Of Auxiliary Precautions.

The Great Objects Which Presented Themselves [to The Constitutional Convention] ... Formed A Task More Difficult Than Can Be Well Conceived By Those Who Were Not Concerned In The Execution Of It. Adding To These Considerations The Natural Diversity Of Human Opinions On All New And Complicated Subjects, It Is Impossible To Consider The Degree Of Concord Which Ultimately Prevailed As Less Than A Miracle.

A Just Government Has No Need For The Clergy Or The Church.

Liberty And Order Will Never Be Perfectly Safe Until A Trespass On The Constitution Provisions For Either, Shall Be Felt With The Same Keenness That Resents And Invasion Of The Dearest Rights.

The Ultimate Authority, Wherever The Derivative May Be Found, Resides In The People Alone, And That It Will Not Depend Merely On The Comparative Ambition Or Address Of The Different Governments, Whether Either, Or Which Of Them, Will Be Able To Enlarge Its Sphere Of Jurisdiction At The Expense Of The Other.

The Appointment Of Senators By The State Legislatures . . . Is Recommended By The Double Advantage Of Favoring A Select Appointment, And Of Giving To The State Governments Such An Agency In The Formation Of The Federal Government, As Must Secure The Authority Of The Former.

Torrents Of Blood Have Been Spilt In The World In Vain Attempts Of The Secular Arm To Extinguish Religious Discord, By Proscribing All Differences In Religious Opinions.

Is There A Legislative Power In Fact, Not Expressly Prohibited By The Constitution, Which Might Not, According To The Doctrine Of The Court, Be Exercised As A Means Of Carrying Into Effect Some Specified Power?

No Error Is More Certain Than The One Proceeding From A Hasty And Superficial View Of The Subject.

That Is Not A Just Government, Nor Is Property Secure Under It, Where The Property Which A Man Has In His Personal Safety And Personal Liberty, Is Violated By Arbitrary Seizures Of One Class Of Citizens For The Service Of The Rest.

There Is No Maxim, In My Opinion, Which Is More Liable To Be Misapplied, And Which, Therefore, More Needs Elucidation, Than The Current One, That The Interest Of The Majority Is The Political Standard Of Right And Wrong.

One Nation Is To Another What One Individual Is To Another; With This Melancholy Distinction Perhaps, That The Former With Fewer Of The Benevolent Emotions Than The Latter, Are Under Fewer Restraints Also From Taking Undue Advantage Of The Indiscretions Of Each Other.

It Degrades From The Equal Rank Of Citizens All Those Whose Opinions In Religion Do Not Bend To Those Of The Legislative Authority. Distant As It May Be In Its Present Form From The Inquisition, It Differs From It Only In Degree.

The Inference To Which We Are Brought Is That The Causes Of Faction Cannot Be Removed And That Relief Is Only To Be Sought In The Means Of Controlling Its Effects.

As The War Was Just In Its Origin And Necessary And Noble In Its Objects, We Can Reflect With A Proud Satisfaction That In Carrying It On No Principle Of Justice Or Honor, No Usage Of Civilized Nations, No Precept Of Courtesy Or Humanity, Have Been Infringed.

To Suppose That Any Form Of Government Will Secure Liberty Or Happiness Without Any Virtue In The People, Is A Chimerical Idea.

The President Is Responsible To The Public For The Conduct Of The Person He Has Nominated And Appointed.

Religion, Or The Duty We Owe To Our Creator, And Manner Of Discharging It, Can Be Directed Only By Reason And Conviction, Not By Force Or Violence; And, Therefore, That All Men Should Enjoy The Fullest Toleration In The Exercise Of Religion According To The Dictates Of Conscience, Unpunished And Unrestrained By The Magistrate, Unless Under Color Of Religion Any Man Disturb The Peace, The Happiness, Or Safety Of Society, And That It Is The Mutual Duty Of All To Practice Christian Forbearance, Love And Charity Toward Each Other.

Strongly Guarded As Is The Separation Between Religion And Government In The Constitution Of The United States, The Danger Of Encroachment By Ecclesiastical Bodies May Be Illustrated By Precedents Already Furnished In Their Short History.

Justice Is The End Of Government. It Is The End Of Civil Society. It Ever Has Been And Ever Will Be Pursued Until It Be Obtained, Or Until Liberty Be Lost In The Pursuit.

It Is Superfluous To Try By The Standards Of Theory, A Part Of The Constitution Which Is Allowed On All Hands To Be The Result Not Of Theory, But "of A Spirit Of Amity, And That Mutual Deference And Concession Which The Peculiarity Of Our Political Situation Rendered Indispensable" . . . The Equal Vote Allowed To Each State, Is At Once A Constitutional Recognition Of The Portion Of Sovereignty Remaining In The Individual States, And An Instrument For Preserving That Residuary Sovereignty.

Thus The Right Of Nullification Meant By Mr. Jefferson Is The Natural Right, Which All Admit To Be A Remedy Against Insupportable Oppression.

I Go On The Principle That A Public Debt Is A Public Curse And In A Republican Government More Than In Any Other.

Public Opinion Sets Bounds To Every Government, And Is The Real Sovereign In Every Free One.

Congress Should Not Establish A Religion, And Enforce The Legal Observation Of It By Law, Nor Compel Men To Worship God In Any Manner Contrary To Their Conscience.

Are Not The Daily Devotions Conducted By These Legal Ecclesiastics Already Degenerating Into A Scanty Attendance, And A Tiresome Formality?

[in A Democracy] A Common Passion Or Interest Will, In Almost Every Case , Be Felt By A Majority Of The Whole; A Communication And Concert Results From The Form Of Government Itself; And There Is Nothing To Check The Inducements To Sacrifice The Weaker Party Or An Obnoxious Individual.

I Have Received Your Letter Of The 6th, With The Eloquent Discourse Delivered At The Consecration Of The Jewish Synagogue. Having Ever Regarded The Freedom Of Religious Opinions And Worship As Equally Belonging To Every Sect, And The Secure Enjoyment Of It As The Best Human Provision For Bringing All Either Into The Same Way Of Thinking, Or Into That Mutual Charity Which Is The Only Substitute, I Observe With Pleasure The View You Give Of The Spirit In Which Your Sect Partake Of The Blessings Offered By Our Government And Laws.

Government Destitute Of Energy, Will Ever Produce Anarchy.

I Own Myself The Friend To A Very Free System Of Commerce, And Hold It As A Truth, That Commercial Shackles Are Generally Unjust, Oppressive And Impolitic - It Is Also A Truth, That If Industry And Labour Are Left To Take Their Own Course, They Will Generally Be Directed To Those Objects Which Are The Most Productive, And This In A More Certain And Direct Manner Than The Wisdom Of The Most Enlightened Legislature Could Point Out.

The Rights Of Persons, And The Rights Of Property, Are The Objects, For The Protection Of Which Government Was Instituted.

As The People Of The United States Enjoy The Great Merit Of Having Established A System Of Government On The Basis Of Human Rights, And Of Giving It A Form Without Example, Which, As They Believe, Unites The Greatest National Strength With The Best Security For Public Order And Individual Liberty, They Owe To Themselves, To Their Posterity And To The World, A Preservation Of The System In Its Purity, Its Symmetry, And Its Authenticity.

A Republic, By Which I Mean A Government In Which The Scheme Of Representation Takes Place, Opens A Different Prospect And Promises The Cure For Which We Are Seeking.
