The House Of Representatives ... Can Make No Law, Which Will Not Have Its Full Operation On Themselves And Their Friends, As Well As The Great Mass Of Society. When Men Exercise Their Reason Coolly And Freely, On A Variety Of Distinct Questions, They Inevitably Fall Into Different Opinions, On Some Of Them. When They Are Governed By A Common Passion, Their Opinions If They Are So To Be Called, Will Be The Same.

We Have Seen That The Tendency Of Republican Governments Is To An Aggrandizement Of The Legislative At The Expense Of The Other Departments. The Appeals To The People, Therefore, Would Usually Be Made By The Executive And Judiciary Departments.

I Have Received Your Letter Of The 6th, With The Eloquent Discourse Delivered At The Consecration Of The Jewish Synagogue. Having Ever Regarded The Freedom Of Religious Opinions And Worship As Equally Belonging To Every Sect, And The Secure Enjoyment Of It As The Best Human Provision For Bringing All Either Into The Same Way Of Thinking, Or Into That Mutual Charity Which Is The Only Substitute, I Observe With Pleasure The View You Give Of The Spirit In Which Your Sect Partake Of The Blessings Offered By Our Government And Laws.

A Spirit Of Faction . . . Will Often Hurry The Persons Of Whom They Were Composed Into Improprieties And Excesses For Which They Would Blush In A Private Capacity.

Religious Bondage Shackles And Debilitates The Mind And Unfits It For Every Noble Enterprise.... During Almost Fifteen Centuries Has The Legal Establishment Of Christianity Been On Trial. What Have Been Its Fruits? More Or Less, In All Places, Pride And Indolence In The Clergy; Ignorance And Servility In Laity; In Both, Superstition, Bigotry, And Persecution.

Extend The Sphere And You Take In A Greater Variety Of Parties And Interests; You Make It Less Probable That A Majority Of The Whole Will Have Common Motive To Invade The Rights Of Other Citizens.

The Management Of Foreign Relations Appears To Be The Most Susceptible Of Abuse Of All The Trusts Committed To A Government, Because They Can Be Concealed Or Disclosed, Or Disclosed In Such Parts And At Such Times As Will Best Suit Particular Views; And Because The Body Of The People Are Less Capable Of Judging, And Are More Under The Influence Of Prejudices, On That Branch Of Their Affairs, Than Of Any Other. Perhaps It Is A Universal Truth That The Loss Of Liberty At Home Is To Be Charged To Provisions Against Danger, Real Or Pretended, From Abroad.

It Is A Melancholy Reflection That Liberty Should Be Equally Exposed To Danger Whether The Government Have Too Much Power Or Too Little Power And That The Line Which Divides These Extremes Should Be So Inaccurately Defined By Experience.

Some Degree Of Abuse Is Inseparable From The Proper Use Of Everything.

I Do Not Conceive That Power Is Given To The President And Senate To Dismember The Empire, Or To Alienate Any Great, Essential Right. I Do Not Think The Whole Legislative Authority Have This Power. The Exercise Of The Power Must Be Consistent With The Object Of The Delegation.

To Refer The Power In Question To The Clause "to Provide For The Common Defense And General Welfare" Would Be Contrary To The Established And Consistent Rules Of Interpretation, As Rendering The Special And Careful Enumeration Of Powers Which Follow The Clause Nugatory And Improper. Such A View Of The Constitution Would Have The Effect Of Giving To Congress A General Power Of Legislation Instead Of The Defined And Limited One Hitherto Understood To Belong To Them, The Terms "common Defense And General Welfare" Embracing Every Object And Act Within The Purview Of A Legislative Trust.

The First Question That Offers Itself Is, Whether The General Form And Aspect Of The Government Be Strictly Republican? It Is Evident That No Other Form Would Be Reconcileable With The Genius Of The People Of America; With The Fundamental Principles Of The Revolution; Or With That Honourable Determination Which Animates Every Votary Of Freedom, To Rest All Our Political Experiments On The Capacity Of Mankind For Self-government.

We Have The Self-evident Right To Regulate Our Trade According To Our Own Will And Our Own Interest . . . . This Right Can Be Denied To No Independent Nation.

To Provide Employment For The Poor, And Support For The Indigent, Is Among The Primary, And, At The Same Time, Not Least Difficult Cares Of The Public Authority.

But The Most Deplorable Effect Of All, Is That Diminution Of Attachment And Reverence, Which Steals Into The Hearts Of The People, Towards A Political System Which Betrays So Many Marks Of Infirmity, And Disappoints So Many Of Their Flattering Hopes. No Government, Any More Than An Individual, Will Long Be Respected, Without Being Truly Respectable; Nor Be Truly Respectable, Without Possessing A Certain Portion Of Order And Stability.

Of All The Enemies To Public Liberty War Is, Perhaps, The Most To Be Dreaded, Because It Comprises And Develops The Germ Of Every Other. War Is The Parent Of Armies; From These Proceed Debts And Taxes; And Armies, Debts, And Taxes Are The Known Instruments For Bringing The Many Under The Domination Of The Few... No Nation Could Preserve Its Freedom In The Midst Of Continual Warfare.

It Is Too Early For Politicians To Presume On Our Forgetting That The Public Good, The Real Welfare Of The Great Body Of The People, Is The Supreme Object To Be Pursued; And That No Form Of Government Whatever Has Any Other Value Than As It May Be Fitted For The Attainment Of This Object.

It Is A Misfortune Incident To Republican Government, Though In A Less Degree Than To Other Governments, That Those Who Administer It, May Forget Their Obligations To Their Constituents, And Prove Unfaithful To Their Important Trust.

If Congress Can Employ Money Indefinitely To The General Welfare... They May Appoint Teachers In Every State... The Powers Of Congress Would Subvert The Very Foundation, The Very Nature Of The Limited Government Established By The People Of America.

The Most Productive System Of Finance Will Always Be The Least Burdensome.

The Class Of Citizens Who Provide At Once Their Own Food And Their Own Raiment, May Be Viewed As The Most Truly Independent And Happy. They Are More: They Are The Best Basis Of Public Liberty, And The Strongest Bulwark Of Public Safety. It Follows, That The Greater The Proportion Of This Class To The Whole Society, The More Free, The More Independent, And The More Happy Must Be The Society Itself.

In The First Place, It Is To Be Remembered, That The General Government Is Not To Be Charged With The Whole Power Of Making And Administering Laws. Its Jurisdiction Is Limited To Certain Enumerated Objects, Which Concern All The Members Of The Republic, But Which Are Not To Be Attained By The Separate Provisions Of Any.

The Liberal Appropriations Made By The Legislature Of Kentucky For A General System Of Education Cannot Be Too Much Applauded . . . . Learned Institutions Ought To Be The Favorite Objects With Every Free People. They Throw That Light Over The Public Mind Which Is The Best Security Against Crafty And Dangerous Encroachments On The Public Liberty . . . . What Spectacle Can Be More Edifying Or More Seasonable Than That Of Liberty And Learning, Each Leaning On The Other For Their Mutual And Surest Support?

Of All The Objections Which Have Been Framed Against The Federal Constitution, This Is Perhaps The Most Extraordinary. Whilst The Objection Itself Is Levelled Against A Pretended Oligarchy, The Principle Of It Strikes At The Very Root Of Republican Government.

The Smaller The Number And The More Permanent And Conspicuous The Station Of Men In Power, The Stronger Must Be The Interest Which They Will Individually Feel In Whatever Concerns The Government.

In War, Too, The Discretionary Power Of The Executive Is Extended; Its Influence In Dealing Out Offices, Honors, And Emoluments Is Multiplied; And All The Meaning Of Seducing The Minds, Are Added To Those Of Subduing The Force, Of The People. The Same Malignant Aspect In Republicanism May Be Traced In The Inequality Of Fortunes, And The Opportunities Of Fraud, Growing Out Of A State Of War, And In The Degeneracy Of Manners And Morals, Engendered By Both. No Nation Could Preserve Its Freedom In The Midst Of Continual Warfare.

That Is Not A Just Government Where Arbitrary Restrictions, Exemptions, And Monopolies Deny To Part Of Its Citizens That Free Use Of Their Faculties, And Free Choice Of Their Occupations.

War Should Only Be Declared By The Authority Of The People, Whose Toils And Treasures Are To Support Its Burdens, Instead Of The Government Which Is To Reap Its Fruits.

The Government Of The United States Is A Definite Government, Confined To Specified Objects. It Is Not Like The State Governments, Whose Powers Are More General. Charity Is No Part Of The Legislative Duty Of The Government.

Learned Institutions Ought To Be Favorite Objects With Every Free People. They Throw That Light Over The Public Mind Which Is The Best Security Against Crafty And Dangerous Encroachments On The Public Liberty.

A Zeal For Different Opinions Concerning Religion, Concerning Government, And Many Other Points, As Well Of Speculation As Of Practice; An Attachment To Different Leaders Ambitiously Contending For Pre-eminence And Power; Or To Persons Of Other Descriptions Whose Fortunes Have Been Interesting To The Human Passions, Have, In Turn, Divided Mankind Into Parties, Inflamed Them With Mutual Animosity, And Rendered Them Much More Disposed To Vex And Oppress Each Other Than To Co-operate For Their Common Good.

Americans Have The Right And Advantage Of Being Armed - Unlike The Citizens Of Other Countries Whose Governments Are Afraid To Trust The People With Arms.

Toleration Is Not The Opposite Of Intolerance, But Is The Counterfeit Of It. Both Are Despotisms. The One Assumes To Itself The Right Of Withholding Liberty Of Conscience, The Other Of Granting It.

Each State, In Ratifying The Constitution, Is Considered As A Sovereign Body, Independent Of All Others, And Only To Be Bound By Its Own Voluntary Act. In This Relation, Then, The New Constitution Will, If Established, Be A Federal, And Not A National Constitution.

Ingratitude Is A Common Topic Of Declamation Against Human Nature; And It Must Be Confessed, That Instances Of It Are But Too Infrequent And Flagrant Both In Public And In Private Life. But The Universal And Extreme Indignation Which It Inspires, Is Itself A Proof Of The Energy And Prevalence Of The Contrary Sentiment.

Landholders Ought To Have A Share In The Government To Support These Invaluable Interests And Check The Other Many. They Ought To Be So Constituted As To Protect The Minority Of The Opulent Against The Majority.
