The Means Of Defence Against Foreign Danger Have Been Always The Instruments Of Tyranny At Home. Among The Romans It Was A Standing Maxim To Excite A War, Whenever A Revolt Was Apprehended. Throughout All Europe, The Armies Kept Up Under The Pretext Of Defending, Have Enslaved The People.

We Are Right To Take Alarm At The First Experiment Upon Our Liberties.

What Is To Be The Consequence, In Case The Congress Shall Misconstrue This Part [the Necessary And Proper Clause] Of The Constitution And Exercise Powers Not Warranted By Its True Meaning, I Answer The Same As If They Should Misconstrue Or Enlarge Any Other Power Vested In Them . . . The Success Of The Usurpation Will Depend On The Executive And Judiciary Departments, Which Are To Expound And Give Effect To The Legislative Acts; And In A Last Resort A Remedy Must Be Obtained From The People, Who Can By The Elections Of More Faithful Representatives, Annul The Acts Of The Usurpers.

The Constitution Of The United States Was Created By The People Of The United States Composing The Respective States, Who Alone Had The Right.

The People Shall Not Be Restrained From Peacefully Assembling And Consulting For Their Common Good, Nor From Applying To The Legislature By Petitions, Or Remonstrances For Redress Of Their Grievances.

Freedom Of Speech

So Strong Is This Propensity Of Mankind To Fall Into Mutual Animosities, That Where No Substantial Occasion Presents Itself, The Most Frivolous And Fanciful Distinctions Have Been Sufficient To Kindle Their Unfriendly Passions And Excite Their Most Violent Conflicts. But The Most Common And Durable Source Of Factions Has Been The Various And Unequal Distribution Of Property.

There Is Not A More Important And Fundamental Principle In Legislation, Than That The Ways And Means Ought Always To Face The Public Engagements; That Our Appropriations Should Ever Go Hand In Hand With Our Promises. To Say That The United States Should Be Answerable For Twenty-five Millions Of Dollars Without Knowing Whether The Ways And Means Can Be Provided, And Without Knowing Whether Those Who Are To Succeed Us Will Think With Us On The Subject, Would Be Rash And Unjustifiable. Sir, In My Opinion, It Would Be Hazarding The Public Faith In A Manner Contrary To Every Idea Of Prudence.

Happily For The States, They Enjoy The Utmost Freedom Of Religion. This Freedom Arises From That Multiplicity Of Sects Which Pervades America, And Which Is The Best And Only Security For Religious Liberty In Any Society.

To What Expedient Then Shall We Finally Resort, For Maintaining In Practice The Necessary Partition Of Power Among The Several Departments, As Laid Down In The Constitution? The Only Answer That Can Be Given Is, That As All These Exterior Provisions Are Found To Be Inadequate, The Defect Must Be Supplied, By So Contriving The Interior Structure Of The Government, As That Its Several Constituent Parts May, By Their Mutual Relations, Be The Means Of Keeping Each Other In Their Proper Places.

It Is Certain That Every Class Is Interested In [educational] Establishments Which Give To The Human Mind Its Highest Improvements, And To Every Country Its Truest And Most Durable Celebrity.

A Government Resting On The Minority Is An Aristocracy, Not A Republic, And Could Not Be Safe With A Numerical And Physical Force Against It, Without A Standing Army, An Enslaved Press And A Disarmed Populace.

It Is The Duty Of Every Man To Render To The Creator Such Homage And Such Only As He Believes To Be Acceptable To Him. This Duty Is Precedent, Both In Order Of Time And In Degree Of Obligation, To The Claims Of Civil Society.

Are Not The Daily Devotions Conducted By These Legal Ecclesiastics Already Degenerating Into A Scanty Attendance, And A Tiresome Formality?

I Consider The Difference Between A System Founded On The Legislatures Only, And One Founded On The People, To Be The True Difference Between A League Or Treaty And A Constitution.

The Alien Bill Proposed In The Senate Is A Monster That Must Forever Disgrace Its Parents.

A Dependence On The People Is, No Doubt, The Primary Control On The Government; But Experience Has Taught Mankind The Necessity Of Auxiliary Precautions.

I Consider It…as Subverting The Fundamental And Characteristic Principle Of The Government…and As Bidding Defiance To The Sense In Which The Constitution Is Known To Have Been Proposed, Advocated, And Adopted. If Congress Can Do Whatever In Their Discretion Can Be Done By Money, And Will Promote The General Welfare, The Government Is No Longer A Limited One.

The Public Affairs Of The Union Are Spread Throughout A Very Extensive Region, And Are Extremely Diversified By The Local Affairs Connected With Them, And Can With Difficulty Be Learnt In Any Other Place, Than In The Central Councils, To Which A Knowledge Of Them Will Be Brought By The Representatives Of Every Part Of The Empire. Yet Some Knowledge Of The Affairs, And Even Of The Laws Of All The States, Ought To Be Possessed By The Members From Each Of The States.

I Go By The Great Republican Principle, That The People Will Have The Virtue And Intelligence To Select Men Of Virtue And Wisdom [to The Offices Of Government].

History Records That The Money Changers Have Used Every Form Of Abuse, Intrigue, Deceit, And Violent Means Possible To Maintain Their Control Over Governments By Controlling Money And It's Issuance.

Another Advantage Accruing From This Ingredient In The Constitution Of A Senate, Is The Additional Impediment It Must Prove Against Improper Acts Of Legislation. No Law Or Resolution Can Now Be Passed Without The Concurrence First Of A Majority Of The People, And Then Of A Majority Of The States.

At Cheaper And Nearer Seats Of Learning Parents With Slender Incomes May Place Their Sons In A Course Of Education Putting Them On A Level With The Sons Of The Richest.

In Time Of Actual War, Great Discretionary Powers Are Constantly Given To The Executive Magistrate. Constant Apprehension Of War, Has The Same Tendency To Render The Head Too Large For The Body. A Standing Military Force, With An Overgrown Executive Will Not Long Be Safe Companions To Liberty.

A Republic, By Which I Mean A Government In Which The Scheme Of Representation Takes Place, Opens A Different Prospect And Promises The Cure For Which We Are Seeking.

I, Sir, Have Always Conceived - I Believe Those Who Proposed The Constitution Conceived,and It Is Still More Fully Known, And More Material To Observe, Those Who Ratified The Constitution Conceived, That This Is Not An Indefinite Government Deriving Its Powers From The General Terms Prefixed To The Specified Powers - But, A Limited Government Tied Down To The Specified Powers, Which Explain And Define The General Terms.

In The Extent And Proper Structure Of The Union, Therefore, We Behold A Republican Remedy For The Disease Incident To Republican Government.

In Republican Government The Legislative Authority Necessarily Predominates. The Remedy For This . . . Is To Divide The Legislature Into Different Branches; And To Render Them By Different Modes Of Election, And Different Principles Of Action, As Little Connected With Each Other As The Nature Of Their Common Functions, And Their Common Dependence On The Society, Will Admit.

Temporary Deviations From Fundamental Principles Are Always More Or Less Dangerous. When The First Pretext Fails, Those Who Become Interested In Prolonging The Evil Will Rarely Be At A Loss For Other Pretexts.

[i]t Is More Convenient To Prevent The Passage Of A Law, Than To Declare It Void After It Has Passed.

Americans Need Not Fear The Federal Government Because They Enjoy The Advantage Of Being Armed, Which You Possess Over The People Of Almost Every Other Nation.

The Problem To Be Solved Is, Not What Form Of Government Is Perfect, But Which Of The Forms Is Least Imperfect.

The Regulation Of These Various And Interfering Interests Forms The Principal Task Of Modern Legislation And Involves The Spirit Of Party And Faction In The Necessary And Ordinary Operations Of Government.

In All The Co-temporary Discussions And Comments, Which The Constitution Underwent, It Was Constantly Justified And Recommended On The Ground, That The Powers Not Given To The Government, Were Withheld From It.

Liberty And Order Will Never Be Perfectly Safe Until A Trespass On The Constitution Provisions For Either, Shall Be Felt With The Same Keenness That Resents And Invasion Of The Dearest Rights.

It Is Vain To Say That Enlightened Statesmen Will Always Be Able To Adjust Their Interests. Enlightened Men Will Not Always Be At The Helm.

To Consider The Degree Of Concord Which Ultimately Prevailed As Less Than A Miracle.

In A Free Government The Security For Civil Rights Must Be The Same As That For Religious Rights.

Inference Is Founded Upon Obvious Reasons. Regard To Reputation Has A Less Active Influence, When The Infamy Of A Bad Action Is To Be Divided Upon A Number, Than When It Is To Fall Singly Upon One. The Circulation Of Confidence Is Better Than The Circulation Of Money.

Power Is Of An Encroaching Nature.

The Infant Periods Of Most Nations Are Buried In Silence Or Veiled In Fable; And The World Perhaps Has Lost But Little Which It Needs Regret. The Origin And Outset Of The American Republic Contain Lessons Of Which Posterity Ought Not To Be Deprived: And Happily There Never Was A Case In Which Every Interesting Incident Could Be So Accurately Preserved.

Another Of My Wishes Is To Depend As Little As Possible On The Labour Of Slaves.

As The Legislative, Executive, And Judicial Departments Of The United States Are Co-ordinate, And Each Equally Bound To Support The Constitution, It Follows That Each Must In The Exercise Of Its Functions Be Guided By The Text Of The Constitution According To Its Own Interpretation Of It.

And I Have No Doubt That Every New Example Will Succeed, As Every Past One Has Done, In Showing That Religion And Government Will Both Exist In Greater Purity, The Less They Are Mixed Together.

There Ought Always To Be A Constitutional Method Of Giving Efficacy To Constitutional Provisions. What For Instance Would Avail Restrictions On The Authority Of The State Legislatures, Without Some Constitutional Mode Of Enforcing The Observance Of Them? . . . This Power Must Either Be A Direct Negative On The State Laws, Or An Authority In The Federal Courts, To Over-rule Such As Might Be In Manifest Contravention Of The Articles Of Union.

The Advice Nearest To My Heart And Deepest In My Convictions Is That The Union Of The States Be Cherished And Perpetuated.

[in Government] The Constant Aim Is To Divide And Arrange The Several Offices In Such A Manner As That Each May Be A Check On The Other-that The Private Interest Of Every Individual May Be A Sentinel Over The Public Rights.

Man, Who Preys Both On The Vegetable And Animal Species, Is Himself A Prey To Neither. He Too Possesses The Reproductive Principle Far Beyond The Degree Requisite For The Bare Continuance Of His Species. What Becomes Of The Surplus Of Human Life To Which This Principle Is Competent?

If We Are To Take For The Criterion Of Truth The Majority Of Suffrages, They Ought To Be Gotten From Those Philosophic And Patriotic Citizens Who Cultivate Their Reason.

Conscience Is The Most Sacred Of All Property; Other Property Depending In Part On Positive Law, The Exercise Of That Being A Natural And Unalienable Right. To Guard A Man's House As His Castle, To Pay Public And Enforce Private Debts With The Most Exact Faith, Can Give No Title To Invade A Man's Conscience, Which Is More Sacred Than His Castle, Or To Withhold From It That Debt Of Protection For Which The Public Faith Is Pledged By The Very Nature And Original Conditions Of The Social Pact.

In No Instance Have... The Churches Been Guardians Of The Liberties Of The People.

The People Can Never Willfully Betray Their Own Interests: But They May Possibly Be Betrayed By The Representatives Of The People; And The Danger Will Be Evidently Greater Where The Whole Legislative Trust Is Lodged In The Hands Of One Body Of Men, Than Where The Concurrence Of Separate And Dissimilar Bodies Is Required In Every Public Act.

May It Not Be Asked Of Every Intelligent Friend To The Liberties Of His Country, Whether The Power Exercised In Such An Act As This Ought Not To Produce Great And Universal Alarm? Whether A Rigid Execution Of Such An Act, In Time Past, Would Not Have Repressed That Information And Communication Among The People Which Is Indispensable To The Just Exercise Of Their Electoral Rights? And Whether Such An Act, If Made Perpetual, And Enforced With Rigor, Would Not, In Time To Come, Either Destroy Our Free System Of Government, Or Prepare A Convulsion That Might Prove Equally Fatal To It?

I Have Ever Regarded The Freedom Of Religious Opinions And Worship As Equally Belonging To Every Sect.

You Give Me A Credit To Which I Have No Claim In Calling Me "the Writer Of The Constitution Of The United States." This Was Not, Like The Fabled Goddess Of Wisdom, The Offspring Of A Single Brain. It Ought To Be Regarded As The Work Of Many Heads And Many Hands.

The First Question That Offers Itself Is, Whether The General Form And Aspect Of The Government Be Strictly Republican? It Is Evident That No Other Form Would Be Reconcileable With The Genius Of The People Of America; With The Fundamental Principles Of The Revolution; Or With That Honourable Determination Which Animates Every Votary Of Freedom, To Rest All Our Political Experiments On The Capacity Of Mankind For Self-government.

Among The Features Peculiar To The Political System Of The United States Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect. [...] Equal Laws Protecting Equal Rights, Are Found As They Ought To Be Presumed, The Best Guarantee Of Loyalty, And Love Of Country; As Well As Best Calculated To Cherish That Mutual Respect And Good Will Among Citizens Of Every Religious Denomination Which Are Necessary To Social Harmony And Most Favorable To The Advancement Of Truth.

Among The Features Peculiar To The Political System Of The United States, Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect.

The States Then Being The Parties To The Constitutional Compact, And In Their Sovereign Capacity, It Follows Of Necessity, That There Can Be No Tribunal Above Their Authority, To Decide In The Last Resort, Whether The Compact Made By Them Be Violated; And Consequently That As The Parties To It, They Must Themselves Decide In The Last Resort, Such Questions As May Be Of Sufficient Magnitude To Require Their Interposition.

The Proposed Constitution, Therefore, Even When Tested By The Rules Laid Down By Its Antagonists, Is, In Strictness, Neither A National Nor A Federal Constitution; But A Composition Of Both. In Its Foundation It Is Federal, Not National; In The Sources From Which The Ordinary Powers Of The Government Are Drawn, It Is Partly Federal, And Partly National; In The Operation Of These Powers, It Is National, Not Federal; In The Extent Of Them Again, It Is Federal, Not National; And Finally, In The Authoritative Mode Of Introducing Amendments, It Is Neither Wholly Federal, Nor Wholly National.

Landholders Ought To Have A Share In The Government To Support These Invaluable Interests And Check The Other Many. They Ought To Be So Constituted As To Protect The Minority Of The Opulent Against The Majority.

The Operations Of The Federal Government Will Be Most Extensive And Important In Times Of War And Danger; Those Of The State Governments, In Times Of Peace And Security.

The Latent Causes Of Faction Are Thus Sown In The Nature Of Man; And We See Them Everywhere Brought Into Different Degrees Of Activity, According To The Different Circumstances Of Civil Society.

If We Resort For A Criterion To The Different Principles On Which Different Forms Of Government Are Established, We May Define A Republic To Be, Or At Least May Bestow That Name On, A Government Which Derives All Its Powers Directly Or Indirectly From The Great Body Of The People, And Is Administered By Persons Holding Their Offices During Pleasure For A Limited Period, Or During Good Behavior.

It Is To The Press Mankind Are Indebted For Having Dispelled The Clouds Which So Long Encompassed Religion, For Disclosing Her Genuine Lustre, And Disseminating Her Salutary Doctrines.

What Is Government Itself But The Greatest Of All Reflections On Human Nature? If Men Were Angels, No Government Would Be Necessary. If Angels Were To Govern Men, Neither External Nor Internal Controls On Government Would Be Necessary.

The Management Of Foreign Relations Appears To Be The Most Susceptible Of Abuse Of All The Trusts Committed To A Government, Because They Can Be Concealed Or Disclosed, Or Disclosed In Such Parts And At Such Times As Will Best Suit Particular Views; And Because The Body Of The People Are Less Capable Of Judging, And Are More Under The Influence Of Prejudices, On That Branch Of Their Affairs, Than Of Any Other. Perhaps It Is A Universal Truth That The Loss Of Liberty At Home Is To Be Charged To Provisions Against Danger, Real Or Pretended, From Abroad.

Precedents Once Established Are So Much Positive Power.

Those Who Proposed The Constitution Knew, And Those Who Ratified The Constitution Also Knew That This Is...a Limited Government Tied Down To Specified Powers....it Was Never Supposed Or Suspected That The Old Congress Could Give Away The Money Of The States To Encourage Agriculture Or For Any Other Purpose They Pleased.

What Is The Structure Of Government That Will Best Guard Against The Precipitate Counsels And Factious Combinations For Unjust Purposes, Without A Sacrifice Of The Fundamental Principle Of Republicanism?

In The Compound Republic Of America, The Power Surrendered By The People Is First Divided Between Two Distinct Governments, And Then The Portion Allotted To Each Subdivided Among Distinct And Separate Governments. Hence A Double Security Arises To The Rights Of The People. The Different Governments Will Control Each Other, At The Same Time That Each Will Be Controlled By Itself.

Besides The Obscurity Arising From The Complexity Of Objects, And The Imperfection Of The Human Faculties, The Medium Through Which The Conceptions Of Men Are Conveyed To Each Other Adds A Fresh Embarrassment.

It Is Possible That These May All Be Insufficient To Control The Caprice And Wickedness Of Man. But Are They Not All That Government Will Admit, And All That Human Prudence Can Devise?

The Powers Delegated By The Proposed Constitution To The Federal Government Are Few And Defined. Those Which Are To Remain In The State Governments Are Numerous And Indefinite.

Respect For Character Is Always Diminished In Proportion To The Number Among Whom The Blame Or Praise Is To Be Divided.

He Has A Property Of Peculiar Value In His Religious Opinions, And In The Profession And Practice Dictated By Them. In A Word, As A Man Is Said To Have A Right To His Property, He May Be Equally Said To Have A Property In His Rights.

They Can Make No Law Which Will Not Have Its Full Operation On Themselves And Their Friends, As Well As On The Great Mass Of The Society.

The Primary Function Of Government Is To Protect The Minority Of The Opulent From The Majority Of The Poor.

If Tyranny And Oppression Come To This Land, It Will Be In The Guise Of Fighting A Foreign Enemy.

Waiving The Rights Of Conscience, Not Included In The Surrender Implied By The Social State, & More Or Less Invaded By All Religious Establishments, The Simple Question To Be Decided, Is Whether A Support Of The Best & Purest Religion, The Christian Religion Itself Ought Not, So Far At Least As Pecuniary Means Are Involved, To Be Provided For By The Government, Rather Than Be Left To The Voluntary Provisions Of Those Who Profess It.

The Nation Which Reposes On The Pillow Of Political Confidence, Will Sooner Or Later End Its Political Existence In A Deadly Lethargy.

The House Of Representatives ... Can Make No Law, Which Will Not Have Its Full Operation On Themselves And Their Friends, As Well As The Great Mass Of Society. This Has Always Been Deemed One Of The Strongest Bonds By Which Human Policy Can Connect The Rulers And The People Together. It Creates Between Them That Communion Of Interest, And Sympathy Of Sentiments, Of Which Few Governments Have Furnished Examples; But Without Which Every Government Degenerates Into Tyranny.

Religion Flourishes In Greater Purity, Without Than With The Aid Of Government.

I Acknowledge, In The Ordinary Course Of Government, That The Exposition Of The Laws And Constitution Devolves Upon The Judicial. But I Beg To Know Upon What Principle It Can Be Contended That Any One Department Draws From The Constitution Greater Powers Than Another In Marking Out The Limits Of The Powers Of The Several Departments.

The Most That The Convention Could Do In Such A Situation, Was To Avoid The Errors Suggested By The Past Experience Of Other Countries, As Well As Of Our Own; And To Provide A Convenient Mode Of Rectifying Their Own Errors, As Future Experience May Unfold Them.

There Is One View Of The Subject Which Ought To Have Its Influence On Those Who Espouse Doctrines Which Strike At The Authoritative Origin And Efficacious Operation Of The Government Of The United States. The Government Of The U.s. Like All Governments Free In Their Principles, Rests On Compact; A Compact, Not Between The Government & The Parties Who Formed & Live Under It; But Among The Parties Themselves, And The Strongest Of Governments Are Those In Which The Compacts Were Most Fairly Formed And Most Faithfully Executed.

On Any Other Hypothesis, The Delegation Of Judicial Power Would Annul The Authority Delegating It; And The Concurrence Of This Department With The Others In Usurped Powers, Might Subvert Forever, And Beyond The Possible Reach Of Any Rightful Remedy, The Very Constitution Which All Were Instituted To Preserve.
