How A Regulation So Unjust In Itself, So Foreign To The Authority Of Congress, And So Hurtful To The Sale Of Public Land, And Smelling So Strongly Of An Antiquated Bigotry, Could Have Received The Countenance Of A Committee Is Truly A Matter Of Astonishment.

The Right Of Freely Examining Public Characters And Measures, And Of Free Communication Among The People Thereon . . . Has Ever Been Justly Deemed The Only Effectual Guardian Of Every Other Right.

Should Ardent Spirits Be Everywhere Banished From The List Of Drinks, It Will Be A Revolution Not The Least Remarkable In This Revolutionary Age, And Our Country Will Have Its Full Share In That As In Other Merits.

The Two Great Points Of Difference Between A Democracy And A Republic Are: First, The Delegation Of The Government, In The Latter,to A Small Number Of Citizens Elected By The Rest; Secondly, The Greater Number Of Citizens And Greater Sphere Of Country Over Which The Latter May Be Extended.

Happily For The States, They Enjoy The Utmost Freedom Of Religion. This Freedom Arises From That Multiplicity Of Sects Which Pervades America, And Which Is The Best And Only Security For Religious Liberty In Any Society.

America Was Indebted To Immigration For Her Settlement And Prosperity. That Part Of America Which Had Encouraged Them Most Had Advanced Most Rapidly In Population, Agriculture And The Arts.

The Danger Of Silent Accumulations & Encroachments By Ecclesiastical Bodies Have Not Sufficiently Engaged Attention In The U.s. [...] Besides The Danger Of A Direct Mixture Of Religion & Civil Government, There Is An Evil Which Ought To Be Guarded Against In The Indefinite Accumulation Of Property From The Capacity Of Holding It In Perpetuity By Ecclesiastical Corporations. [...] The Establishment Of The Chaplainship To Congs. Is A Palpable Violation Of Equal Rights, As Well As Of Constitutional Principles.

It Is A Melancholy Reflection That Liberty Should Be Equally Exposed To Danger Whether The Government Have Too Much Power Or Too Little Power And That The Line Which Divides These Extremes Should Be So Inaccurately Defined By Experience.

The Rich Man, When Contributing To A Permanent Plan For The Education Of The Poor, Ought To Reflect That He Is Providing For That Of His Own Descendants; And The Poor Man Who Concurs In A Provision For Those Who Are Not Poor That At No Distant Day It May Be Enjoyed By Descendants From Himself. It Does Not Require A Long Life To Witness These Vicissitudes Of Fortune.

The Best Service That Can Be Rendered To A Country, Next To That Of Giving It Liberty, Is In Diffusing The Mental Improvement Equally Essential To The Preservation, And The Enjoyment Of The Blessing.

The First Question That Offers Itself Is, Whether The General Form And Aspect Of The Government Be Strictly Republican? It Is Evident That No Other Form Would Be Reconcileable With The Genius Of The People Of America; With The Fundamental Principles Of The Revolution; Or With That Honourable Determination Which Animates Every Votary Of Freedom, To Rest All Our Political Experiments On The Capacity Of Mankind For Self-government.

Among The Features Peculiar To The Political System Of The United States, Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect.

The Legislative Department Is Everywhere Extending The Sphere Of Its Activity And Drawing All Power Into Its Impetuous Vortex.

That The Foundation Of Our National Policy Should Be Laid In Private Morality. If Individuals Be Not Influenced By Moral Principles, It Is In Vain To Look For Public Virtue; It Is, Therefore, The Duty Of Legislators To Enforce, Both By Precept And Example, The Utility, As Well As The Necessity, Of A Strict Adherence To The Rules Of Distributive Justice.

It Is To Be The Assent And Ratification Of The Several States, Derived From The Supreme Authority In Each State, The Authority Of The People Themselves. The Act, Therefore Establishing The Constitution, Will Not Be A National, But A Federal Act.

A People Armed And Free, Forms A Barrier Against The Enterprises Of Ambition And Is A Bulwark For The Nation Against Foreign Invasion And Domestic Oppression.

No Man Can Be A Competent Legislator Who Does Not Add To An Upright Intention And A Sound Judgment A Certain Degree Of Knowledge Of The Subject On Which He Is To Legislate.

The Class Of Citizens Who Provide At Once Their Own Food And Their Own Raiment, May Be Viewed As The Most Truly Independent And Happy.

That Is Not A Just Government Where Arbitrary Restrictions, Exemptions, And Monopolies Deny To Part Of Its Citizens That Free Use Of Their Faculties, And Free Choice Of Their Occupations.

The Internal Effects Of A Mutable Policy Are Still More Calamitous. It Poisons The Blessings Of Liberty Itself.

Who Does Not See That The Same Authority Which Can Establish Christianity, In Exclusion Of All Other Religions, May Establish With The Same Ease Any Particular Sect Of Christians, In Exclusion Of All Other Sects?

It Is Not Certain That With This Aid Alone [possession Of Arms], They Would Not Be Able To Shake Off Their Yokes. But Were The People To Posses The Additional Advantages Of Local Governments Chosen By Themselves, Who Could Collect The National Will, And Direct The National Force; And Of Officers Appointed Out Of The Militia, By These Governments And Attached Both To Them And To The Militia, It May Be Affirmed With The Greatest Assurance, That The Throne Of Every Tyranny In Europe Would Be Speedily Overturned, In Spite Of The Legions Which Surround It.

It May Not Be Easy, In Every Possible Case, To Trace The Line Of Separation Between The Rights Of Religion And The Civil Authority With Such Distinctness As To Avoid Collisions And Doubts On Unessential Points. The Tendency To Unsurpastion On One Side Or The Other, Or To A Corrupting Coalition Or Alliance Between Them, Will Be Best Guarded Agst. By An Entire Abstinence Of The Gov't From Interfence In Any Way Whatsoever, Beyond The Necessity Of Preserving Public Order, And Protecting Each Sect Agst. Trespasses On Its Legal Rights By Others.

Is The Appointment Of Chaplains To The Two Houses Of Congress Consistent With The Constitution, And With The Pure Principle Of Religious Freedom? In Strictness The Answer On Both Points Must Be In The Negative. The Constitution Of The U. S. Forbids Everything Like An Establishment Of A National Religion. The Law Appointing Chaplains Establishes A Religious Worship For The National Representatives, To Be Performed By Ministers Of Religion, Elected By A Majority Of Them, And These Are To Be Paid Out Of The National Taxes. Does This Not Involve The Principle Of A National Establishment ... ?

By A Faction, I Understand A Number Of Citizens, Whether Amounting To A Majority Or A Minority Of The Whole, Who Are United And Actuated By Some Common Impulse Of Passion, Or Of Interest... The Latent Causes Of Faction Are Sown In The Nature Of Man.

The Diversity In The Faculties Of Men, From Which The Rights Of Property Originate, Is Not Less An Insuperable Obstacle To An Uniformity Of Interests. The Protection Of These Faculties Is The First Object Of Government.

The Civil Government, Though Bereft Of Every Thing Like An Associated Hierarchy, Possesses The Requisite Stability, And Performs Its Functions With Complete Success; Whilst The Number, The Industry, And The Morality Of The Priesthood, And The Devotion Of The People, Have Been Manifestly Increased By The Total Separation Of The Church From The State.

If We Advert To The Nature Of Republican Government, We Shall Find That The Censorial Power Is In The People Over The Government, And Not In The Government Over The People.

Our Country, If It Does Justice To Itself, Will Be The Workshop Of Liberty To The Civilized World.

If Men Were Angels, There Would Be No Need Of Government.

A Certain Degree Of Preparation For War . . . Affords Also The Best Security For The Continuance Of Peace.

Having Outlived So Many Of My Contemporaries, I Ought Not To Forget That I May Be Thought To Have Outlived Myself.

Liberty Is To Faction, What Air Is To Fire, An Aliment Without Which It Instantly Expires. But It Could Not Be A Less Folly To Abolish Liberty, Which Is Essential To Political Life, Because It Nourishes Faction, Than It Would Be To Wish The Annihilation Of Air, Which Is Essential To Animal Life, Because It Imparts To Fire Its Destructive Agency.

History Records That The Money Changers Have Used Every Form Of Abuse, Intrigue, Deceit, And Violent Means Possible To Maintain Their Control Over Governments By Controlling Money And It's Issuance.

The Regulation Of Commerce, It Is True, Is A New Power; But That Seems To Be An Addition Which Few Oppose And From Which No Apprehensions Are Entertained.

The Personal Right To Acquire Property, Which Is A Natural Right, Gives To Property, When Acquired, A Right To Protection, As A Social Right.

That This Liberty [of The Press] Is Often Carried To Excess; That It Has Sometimes Degenerated Into Licentiousness, Is Seen And Lamented, But The Remedy Has Not Yet Been Discovered. Perhaps It Is An Evil Inseparable From The Good With Which It Is Allied; Perhaps It Is A Shoot Which Cannot Be Stripped From The Stalk Without Wounding Vitally The Plant From Which It Is Torn. However Desirable Those Measures Might Be Which Might Correct Without Enslaving The Press, They Have Never Yet Been Devised In America.

Because The Bill Vests In The Said Incorporated Church An Authority To Provide For The Support Of The Poor And The Education Of Poor Children Of The Same, An Authority Which, Being Altogether Superfluous If The Provision Is To Be The Result Of Pious Charity, Would Be A Precedent For Giving To Religious Societies As Such A Legal Agency In Carrying Into Effect A Public And Civil Duty.

Torrents Of Blood Have Been Spilt In The Old World, By Vain Attempts Of The Secular Arm, To Extinguish Religious Discord, By Proscribing All Difference In Religious Opinion. Time Has At Length Revealed The True Remedy. Every Relaxation Of Narrow And Rigorous Policy, Wherever It Has Been Tried, Has Been Found To Assuage The Disease.

If We Resort For A Criterion To The Different Principles On Which Different Forms Of Government Are Established, We May Define A Republic To Be, Or At Least May Bestow That Name On, A Government Which Derives All Its Powers Directly Or Indirectly From The Great Body Of The People, And Is Administered By Persons Holding Their Offices During Pleasure For A Limited Period, Or During Good Behavior.

These Examples, Though As Unfit For The Imitation, As They Are Repugnant To The Genius Of America, Are Notwithstanding . . . Very Instructive Proofs Of The Necessity Of Some Institution That Will Blend Stability With Liberty.

The Members Of The Legislative Department . . . Are Numerous. They Are Distributed And Dwell Among The People At Large. Their Connections Of Blood, Of Friendship, And Of Acquaintance Embrace A Great Proportion Of The Most Influential Part Of The Society . . . They Are More Immediately The Confidential Guardians Of Their Rights And Liberties.

As Long As The Reason Of Man Continues Fallible, And He Is At Liberty To Exercise It, Different Opinions Will Be Formed. As Long As The Connection Subsists Between His Reason And His Self-love, His Opinions And Passions Will Have A Reciprocal Influence On Each Other, And The Former Will Be Objects To Which The Latter Attach Themselves.

We Look Back, Already, With Astonishment, At The Daring Outrages Committed By Despotism, On The Reason And Rights Of Man; We Look Forward With Joy, To The Period, When It Shall Be Despoiled Of All Its Usurpations, And Bound Forever In The Chains, With Which It Had Loaded Its Miserable Victims.

Americans Need Not Fear The Federal Government Because They Enjoy The Advantage Of Being Armed, Which You Possess Over The People Of Almost Every Other Nation.

There Is No Maxim, In My Opinion, Which Is More Liable To Be Misapplied, And Which, Therefore, More Needs Elucidation, Than The Current One, That The Interest Of The Majority Is The Political Standard Of Right And Wrong.

The Establishment Of The Chaplainship To Congress Is A Palpable Violation Of ... Constitutional Principles.

Those Who Are To Conduct A War Cannot In The Nature Of Things, Be Proper Or Safe Judges, Whether A War Ought To Be Commenced, Continued, Or Concluded.

Temporary Deviations From Fundamental Principles Are Always More Or Less Dangerous. When The First Pretext Fails, Those Who Become Interested In Prolonging The Evil Will Rarely Be At A Loss For Other Pretexts.

Resistance To Tyranny Is Service To God.

Is There A Legislative Power In Fact, Not Expressly Prohibited By The Constitution, Which Might Not, According To The Doctrine Of The Court, Be Exercised As A Means Of Carrying Into Effect Some Specified Power?

In No Instance Have... The Churches Been Guardians Of The Liberties Of The People.

Religious Bondage Shackles And Debilitates The Mind And Unfits It For Every Noble Enterprise, Every Expanded Prospect.

In Republics, The Great Danger Is, That The Majority May Not Sufficiently Respect The Rights Of The Minority.

It Is Very Certain That [the Commerce Clause] Grew Out Of The Abuse Of The Power By The Importing States In Taxing The Non-importing, And Was Intended As A Negative And Preventive Provision Against Injustice Among The States Themselves, Rather Than As A Power To Be Used For The Positive Purposes Of The General Government.

The Purpose Of Separation Of Church And State Is To Keep Forever From These Shores The Ceaseless Strife That Has Soaked The Soil Of Europe With Blood For Centuries.

The Safety And Happiness Of Society Are The Objects At Which All Political Institutions Aim, And To Which All Such Institutions Must Be Sacrificed.

If Congress Can Employ Money Indefinitely To The General Welfare... They May Appoint Teachers In Every State... The Powers Of Congress Would Subvert The Very Foundation, The Very Nature Of The Limited Government Established By The People Of America.

The Better Proof Of Reverence For That Holy Name Would Be Not To Profane It By Making It A Topic Of Legislative Discussion.

A Local Spirit Will Infallibly Prevail Much More In The Members Of Congress Than A National Spirit Will Prevail In The Legislatures Of The Particular States.

But The Most Deplorable Effect Of All, Is That Diminution Of Attachment And Reverence, Which Steals Into The Hearts Of The People, Towards A Political System Which Betrays So Many Marks Of Infirmity, And Disappoints So Many Of Their Flattering Hopes. No Government, Any More Than An Individual, Will Long Be Respected, Without Being Truly Respectable; Nor Be Truly Respectable, Without Possessing A Certain Portion Of Order And Stability.

[the Republican Party] Consists Of Those Who, Believing In The Doctrine That Mankind Are Capable Of Governing Themselves And Hating Hereditary Power As An Insult To The Reason And An Outrage To The Rights Of Men, Are Naturally Offended At Every Public Measure That Does Not Appeal To The Understanding And To The General Interest Of The Community.

The People Of The U.s. Owe Their Independence & Their Liberty, To The Wisdom Of Descrying In The Minute Tax Of 3 Pence On Tea, The Magnitude Of The Evil Comprized In The Precedent. Let Them Exert The Same Wisdom, In Watching Agst Every Evil Lurking Under Plausible Disguises, And Growing Up From Small Beginnings.

The Latent Causes Of Faction Are Thus Sown In The Nature Of Man; And We See Them Everywhere Brought Into Different Degrees Of Activity, According To The Different Circumstances Of Civil Society.

The Happy Union Of These States Is A Wonder; Their Constitution A Miracle; Their Example The Hope Of Liberty Throughout The World.

It Is Due To Justice; Due To Humanity; Due To Truth; Due To The Sympathies Of Our Nature; In Fine, To Our Character As A People, Both Abroad And At Home, That They Should Be Considered, As Much As Possible, In The Light Of Human Beings, And Not As Mere Property. As Such, They Are Acted On By Our Laws, And Have An Interest In Our Laws. They May Be Considered As Making A Part, Though A Degraded Part, Of The Families To Which They Belong.

I Think It Absolutely Necessary That The President Should Have The Power Of Removing His Subordinates From Office; It Will Make Him, In A Peculiar Manner, Responsible For Their Conduct, And Subject Him To Impeachment Himself, If He Suffers Them To Perpetrate With Impunity High Crimes Or Misdemeanors Against The United States, Or Neglects To Superintend Their Conduct, So As To Check Their Excesses.

I Cannot Undertake To Lay My Finger On That Article Of The Constitution Which Granted A Right To Congress Of Expending, On Objects Of Benevolence, The Money Of Their Constituents.

In Time Of Actual War, Great Discretionary Powers Are Constantly Given To The Executive Magistrate. Constant Apprehension Of War, Has The Same Tendency To Render The Head Too Large For The Body. A Standing Military Force, With An Overgrown Executive Will Not Long Be Safe Companions To Liberty.

The Rights Of Persons, And The Rights Of Property, Are The Objects, For The Protection Of Which Government Was Instituted.

The Diversity In The Faculties Of Men, From Which The Rights Of Property Originate, Is Not Less An Insuperable Obstacle To A Uniformity Of Interests. The Protection Of These Faculties Is The First Object Of Government. From The Protection Of Different And Unequal Faculties Of Acquiring Property, The Possession Of Different Degrees And Kinds Of Property Immediately Results; And From The Influence Of These On The Sentiments And Views Of The Respective Proprietors, Ensues A Division Of The Society Into Different Interests And Parties.

In The Compound Republic Of America, The Power Surrendered By The People Is First Divided Between Two Distinct Governments, And Then The Portion Allotted To Each Subdivided Among Distinct And Separate Governments. Hence A Double Security Arises To The Rights Of The People. The Different Governments Will Control Each Other, At The Same Time That Each Will Be Controlled By Itself.

To The Press Alone, Chequered As It Is With Abuses, The World Is Indebted For All The Triumphs Which Have Been Gained By Reason And Humanity Over Error And Oppression.

The Infant Periods Of Most Nations Are Buried In Silence Or Veiled In Fable; And The World Perhaps Has Lost But Little Which It Needs Regret. The Origin And Outset Of The American Republic Contain Lessons Of Which Posterity Ought Not To Be Deprived: And Happily There Never Was A Case In Which Every Interesting Incident Could Be So Accurately Preserved.

That Useful Alterations Will Be Suggested By Experience, Could Not But Be Foreseen . . . . It Moreover Equally Enables The General And State Governments To Originate The Amendment Of Errors As They May Be Pointed Out By The Experience On One Side Or On The Other.

Crisis Is The Rallying Cry Of The Tyrant.

Before Any Man Can Be Considered As A Member Of Civil Society, He Must Be Considered As A Subject Of The Governour Of The Universe: And If A Member Of Civil Society, Do It With A Saving Of His Allegiance To The Universal Sovereign. We Maintain Therefore That In Matters Of Religion, No Man's Right Is Abridged By The Institution Of Civil Society And That Religion Is Wholly Exempt From Its Cognizance.

The Nation Which Reposes On The Pillow Of Political Confidence, Will Sooner Or Later End Its Political Existence In A Deadly Lethargy.

I Consider The Difference Between A System Founded On The Legislatures Only, And One Founded On The People, To Be The True Difference Between A League Or Treaty And A Constitution.

The Constitution Proposed By The Convention May Be Considered Under Two General Points Of View. The First Relates To The Sum Or Quantity Of Power Which It Vests In The Government, Including The Restraints Imposed On The States. The Second, To The Particular Structure Of The Government, And The Distribution Of This Power Among Its Branches.

The Future And Success Of America Is Not In This Constitution, But In The Laws Of God Upon Which This Constitution Is Founded.

And I Have No Doubt That Every New Example Will Succeed, As Every Past One Has Done, In Showing That Religion And Government Will Both Exist In Greater Purity, The Less They Are Mixed Together.

It Would Have Marked A Want Of Foresight In The Convention, Which Our Own Experience Would Have Rendered Inexcusable.

Constitutional Convention

When Men Exercise Their Reason Coolly And Freely, On A Variety Of Distinct Questions, They Inevitably Fall Into Different Opinions, On Some Of Them. When They Are Governed By A Common Passion, Their Opinions If They Are So To Be Called, Will Be The Same.

Philosophy Is Common Sense With Big Words.

No Man Will Subject Himself To The Ridicule Of Pretending That Any Natural Connection Subsists Between The Sun Or The Seasons, And The Period Within Which Human Virtue Can Bear The Temptations Of Power. Happily For Mankind, Liberty Is Not, In This Respect, Confined To Any Single Point Of Time, But Lies Within Extremes, Which Afford Sufficient Latitude For All The Variations Which May Be Required By The Various Situations And Circumstances Of Civil Society.

The President Is Responsible To The Public For The Conduct Of The Person He Has Nominated And Appointed.

In Republican Government The Legislative Authority Necessarily Predominates. The Remedy For This . . . Is To Divide The Legislature Into Different Branches; And To Render Them By Different Modes Of Election, And Different Principles Of Action, As Little Connected With Each Other As The Nature Of Their Common Functions, And Their Common Dependence On The Society, Will Admit.

The People Shall Not Be Deprived Or Abridged Of Their Right To Speak, Or To Publish Their Sentiments; And The Freedom Of The Press, As One Of The Great Bulwarks Of Liberty, Shall Be Inviolable.

In Contemplating The Pecuniary Resources Needed For The Removal Of Such A Number To So Great A Distance [freed Slaves To Africa], My Thoughts And Hopes Have Long Been Turned To The Rich Fund Presented In The Western Lands Of The Nation . . .

Is It Not The Glory Of The People Of America, That Whilst They Have Paid A Decent Regard To The Opinions Of Former Times And Other Nations, They Have Not Suffered A Blind Veneration For Antiquity, For Custom, Or For Names, To Overrule The Suggestions Of Their Own Good Sense, The Knowledge Of Their Own Situation, And The Lessons Of Their Own Experience? To This Manly Spirit, Posterity Will Be Indebted For The Possession, And The World For The Example Of The Numerous Innovations Displayed On The American Theatre, In Favor Of Private Rights And Public Happiness.

That Diabolical Hell Conceived Principle Of Persecution Rages Amoung Some And To Their Eternal Infamy The Clergy Can Furnish Their Quota Of Imps For Such Business.

There Is Not A More Important And Fundamental Principle In Legislation, Than That The Ways And Means Ought Always To Face The Public Engagements; That Our Appropriations Should Ever Go Hand In Hand With Our Promises. In Framing A Government Which Is To Be Administered By Men Over Men, The Great Difficulty Lies In This: You Must First Enable The Government To Control The Governed; And In The Next Place Oblige It To Control Itself. A Dependence On The People Is, No Doubt, The Primary Control On The Government; But Experience Has Taught Mankind The Necessity Of Auxiliary Precautions.
