In Order To Judge Of The Form To Be Given To This Institution The Senate, It Will Be Proper To Take A View Of The Ends To Be Served By It. It Is Superfluous To Try By The Standards Of Theory, A Part Of The Constitution Which Is Allowed On All Hands To Be The Result Not Of Theory, But "of A Spirit Of Amity, And That Mutual Deference And Concession Which The Peculiarity Of Our Political Situation Rendered Indispensable" . . . The Equal Vote Allowed To Each State, Is At Once A Constitutional Recognition Of The Portion Of Sovereignty Remaining In The Individual States, And An Instrument For Preserving That Residuary Sovereignty.

A Pure Democracy, By Which I Mean A Society Consisting Of A Small Number Of Citizens, Who Assemble And Administer The Government In Person, Can Admit Of No Cure For The Mischiefs Of Faction. A Common Passion Or Interest Will, In Almost Every Case, Be Felt By A Majority Of The Whole; A Communication And Concert Result From The Form Of Government Itself; And There Is Nothing To Check The Inducements To Sacrifice The Weaker Party, Or An Obnoxious Individual. Nothing Could Be More Irrational Than To Give The People Power, And To Withhold From Them Information Without Which Power Is Abused.

There Is A Degree Of Depravity In Mankind Which Requires A Certain Degree Of Circumspection And Distrust.

Each State, In Ratifying The Constitution, Is Considered As A Sovereign Body, Independent Of All Others, And Only To Be Bound By Its Own Voluntary Act. In This Relation, Then, The New Constitution Will, If Established, Be A Federal, And Not A National Constitution.

Wherever There Is Interest And Power To Do Wrong, Wrong Will Generally Be Done.

What A Perversion Of The Normal Order Of Things! ... To Make Power The Primary And Central Object Of The Social System, And Liberty But Its Satellite.

The Best Service That Can Be Rendered To A Country, Next To That Of Giving It Liberty, Is In Diffusing The Mental Improvement Equally Essential To The Preservation, And The Enjoyment Of The Blessing.

The Means Of Defence Against Foreign Danger Have Been Always The Instruments Of Tyranny At Home. Among The Romans It Was A Standing Maxim To Excite A War, Whenever A Revolt Was Apprehended. Throughout All Europe, The Armies Kept Up Under The Pretext Of Defending, Have Enslaved The People.

Congress Shall Make No Law Respecting An Establishment Of Religion, Or Prohibiting The Free Exercise Thereof.

It May Not Be Easy, In Every Possible Case, To Trace The Line Of Separation Between The Rights Of Religion And The Civil Authority With Such Distinctness As To Avoid Collisions And Doubts On Unessential Points. May It Not Be Asked Of Every Intelligent Friend To The Liberties Of His Country, Whether The Power Exercised In Such An Act As This Ought Not To Produce Great And Universal Alarm? Whether A Rigid Execution Of Such An Act, In Time Past, Would Not Have Repressed That Information And Communication Among The People Which Is Indispensable To The Just Exercise Of Their Electoral Rights? And Whether Such An Act, If Made Perpetual, And Enforced With Rigor, Would Not, In Time To Come, Either Destroy Our Free System Of Government, Or Prepare A Convulsion That Might Prove Equally Fatal To It?

Those Who Proposed The Constitution Knew, And Those Who Ratified The Constitution Also Knew That This Is...a Limited Government Tied Down To Specified Powers....it Was Never Supposed Or Suspected That The Old Congress Could Give Away The Money Of The States To Encourage Agriculture Or For Any Other Purpose They Pleased.

The Express Authority Of The People Alone Could Give Validity To The Constitution.

The Passions, Therefore, Not The Reason, Of The Public Would Sit In Judgment. But It Is The Reason, Alone, Of The Public, That Ought To Control And Regulate The Government. The Passions Ought To Be Controlled And Regulated By The Government.

I Have No Doubt But That The Misery Of The Lower Classes Will Be Found To Abate Wherever The Government Assumes A Freer Aspect,& The Laws Favor A Subdivision Of Property.

The Eyes Of The World Being Thus On Our Country, It Is Put The More On Its Good Behavior, And Under The Greater Obligation Also, To Do Justice To The Tree Of Liberty By An Exhibition Of The Fine Fruits We Gather From It.

Among The Features Peculiar To The Political System Of The United States Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect. It Is Possible That These May All Be Insufficient To Control The Caprice And Wickedness Of Man. But Are They Not All That Government Will Admit, And All That Human Prudence Can Devise?

The Capacity Of The Female Mind For Studies Of The Highest Order Cannot Be Doubted, Having Been Sufficiently Illustrated By Its Works Of Genius, Of Erudition, And Of Science.

The Preservation Of A Free Government Requires Not Merely That The Metes And Bounds Which Separate Each Department Of Power Be Invariably Maintained; But More Especially That Neither Of Them Be Suffered To Overleap The Great Barrier Which Defends The Rights Of The People. The Rulers Who Are Guilty Of Such An Encroachment, Exceed The Commission From Which They Derive Their Authority And Are Tyrants. The People Who Submit To It Are Governed By Laws Made Neither By Themselves Nor By An Authority Derived From Them, And Are Slaves.

The Diversity In The Faculties Of Men, From Which The Rights Of Property Originate, Is Not Less An Insuperable Obstacle To A Uniformity Of Interests. The Protection Of These Faculties Is The First Object Of Government. From The Protection Of Different And Unequal Faculties Of Acquiring Property, The Possession Of Different Degrees And Kinds Of Property Immediately Results; And From The Influence Of These On The Sentiments And Views Of The Respective Proprietors, Ensues A Division Of The Society Into Different Interests And Parties.

Money Cannot Be Applied To The *general Welfare*, Otherwise Than By An Application Of It To Some *particular* Measure Conducive To The General Welfare. Whenever, Therefore, Money Has Been Raised By The General Authority, And Is To Be Applied To A Particular Measure, A Question Arises Whether The Particular Measure Be Within The Enumerated Authorities Vested In Congress. If It Be, The Money Requisite For It May Be Applied To It; If It Be Not, No Such Application Can Be Made.

If Individuals Be Not Influenced By Moral Principles, It Is In Vain To Look For Public Virtue; It Is, Therefore, The Duty Of Legislators To Enforce, Both By Precept And Example, The Utility, As Well As The Necessity, Of A Strict Adherence To The Rules Of Distributive Justice.

In The Compound Republic Of America, The Power Surrendered By The People Is First Divided Between Two Distinct Governments, And Then The Portion Allotted To Each Subdivided Among Distinct And Separate Governments. Hence A Double Security Arises To The Rights Of The People. The Different Governments Will Control Each Other, At The Same Time That Each Will Be Controlled By Itself.
