The Ultimate Authority Resides In The People, And That If The Federal Government Got Too Powerful And Overstepped Its Authority, Then The People Would Develop Plans Of Resistance And Resort To Arms.

The Apportionment Of Taxes On The Various Descriptions Of Property Is An Act Which Seems To Require The Most Exact Impartiality; Yet There Is, Perhaps, No Legislative Act In Which Greater Opportunity And Temptation Are Given To A Predominant Party To Trample On The Rules Of Justice. Every Shilling Which They Overburden The Inferior Number Is A Shilling Saved To Their Own Pockets.

It Is Vain To Say That Enlightened Statesmen Will Always Be Able To Adjust Their Interests. Enlightened Men Will Not Always Be At The Helm.

Let The Influx Of Money Be Ever So Great, If There Be No Confidence, Property Will Sink In Value... The Circulation Of Confidence Is Better Than The Circulation Of Money.

[in The Case Of] Dangerous Exercise Of Other Powers, Not Granted By The Said Compact, The States, Who Are Parties Thereto, Have The Right, And Are Duty Bound, To Interpose For Arresting The Progress Of The Evil.

Is There No Virtue Among Us? If There Be Not, We Are In A Wretched Situation. No Theoretical Checks-no Form Of Government Can Render Us Secure. To Suppose That Any Form Of Government Will Secure Liberty Or Happiness Without Any Virtue In The People, Is A Chimerical Idea, If There Be Sufficient Virtue And Intelligence In The Community, It Will Be Exercised In The Selection Of These Men. We Have Seen That The Tendency Of Republican Governments Is To An Aggrandizement Of The Legislative At The Expense Of The Other Departments. The Appeals To The People, Therefore, Would Usually Be Made By The Executive And Judiciary Departments.

That This Liberty [of The Press] Is Often Carried To Excess; That It Has Sometimes Degenerated Into Licentiousness, Is Seen And Lamented, But The Remedy Has Not Yet Been Discovered. Perhaps It Is An Evil Inseparable From The Good With Which It Is Allied; Perhaps It Is A Shoot Which Cannot Be Stripped From The Stalk Without Wounding Vitally The Plant From Which It Is Torn. ... Large And Permanent Military Establishments ... Are Forbidden By The Principles Of Free Government, And Against The Necessity Of Which The Militia Were Meant To Be A Constitutional Bulwark.

Another Of My Wishes Is To Depend As Little As Possible On The Labour Of Slaves.

It Is Very Certain That [the Commerce Clause] Grew Out Of The Abuse Of The Power By The Importing States In Taxing The Non-importing, And Was Intended As A Negative And Preventive Provision Against Injustice Among The States Themselves, Rather Than As A Power To Be Used For The Positive Purposes Of The General Government.

I Flatter Myself [we] Have In This Country Extinguished Forever The Ambitious Hope Of Making Laws For The Human Mind.

It Will Be Of Little Avail To The People That The Laws Are Made By Men Of Their Own Choice If The Laws Be So Voluminous That They Cannot Be Read, Or So Incoherent That They Cannot Be Understood.

Conscience Is The Most Sacred Of All Property.

It May Well Happen That The Public Voice, Pronounced By The Representatives Of The People, Will Be More Constant To The Public Good Than If Pronounced By The People Themselves.

The Sober People Of America Are Weary Of The Fluctuating Policy Which Has Directed The Public Councils. They Have Seen With Regret And Indignation That Sudden Changes And Legislative Interferences, In Cases Affecting Personal Rights, Become Jobs In The Hands Of Enterprising And Influential Speculators, And Snares To The More-industrious And Less Informed Part Of The Community. They Have Seen, Too, That One Legislative Interference Is But The First Link Of A Long Chain Of Repetitions, Every Subsequent Interference Being Naturally Produced By The Effects Of The Preceding.

In Republican Government The Legislative Authority Necessarily Predominates. The Remedy For This . . . Is To Divide The Legislature Into Different Branches; And To Render Them By Different Modes Of Election, And Different Principles Of Action, As Little Connected With Each Other As The Nature Of Their Common Functions, And Their Common Dependence On The Society, Will Admit.

Toleration Is Not The Opposite Of Intolerance, But Is The Counterfeit Of It. Both Are Despotisms. The One Assumes To Itself The Right Of Withholding Liberty Of Conscience, The Other Of Granting It.

How Could A Readiness For War In Time Of Peace Be Safely Prohibited, Unless We Could Prohibit, In Like Manner, The Preparations And Establishments Of Every Hostile Nation?

I Have Appealed To Our Own Experience For The Truth Of What I Advance On This Subject [that The Legislative Power Is The Predominant Power]. Were It Necessary To Verify This Experience By Particular Proofs, They Might Be Multiplied Without End. I Might Find A Witness In Every Citizen Who Has Shared In, Or Been Attentive To, The Course Of Public Administrations.

To The Press Alone, Chequered As It Is With Abuses, The World Is Indebted For All The Triumphs Which Have Been Gained By Reason And Humanity Over Error And Oppression.

If There Be A Principle That Ought Not To Be Questioned Within The United States, It Is That Every Man Has A Right To Abolish An Old Government And Establish A New One. This Principle Is Not Only Recorded In Every Public Archive, Written In Every American Heart, And Sealed With The Blood Of American Martyrs, But Is The Only Lawful Tenure By Which The United States Hold Their Existence As A Nation.

History Records That The Money Changers Have Used Every Form Of Abuse, Intrigue, Deceit, And Violent Means Possible To Maintain Their Control Over Governments By Controlling Money And It's Issuance.

In The Compound Republic Of America, The Power Surrendered By The People Is First Divided Between Two Distinct Governments, And Then The Portion Allotted To Each Subdivided Among Distinct And Separate Governments. Hence A Double Security Arises To The Rights Of The People. The Different Governments Will Control Each Other, At The Same Time That Each Will Be Controlled By Itself.

The Definition Of The Right Of Suffrage Is Very Justly Regarded As A Fundamental Article Of Republican Government.

Popular Liberty Might Then Have Escaped The Indelible Reproach Of Decreeing To The Same Citizens, The Hemlock On One Day, And Statues On The Next.

It Is A Principle Incorporated Into The Settled Policy Of America, That As Peace Is Better Than War, War Is Better Than Tribute.

A Sincere And Steadfast Co-operation In Promoting Such A Reconstruction Of Our Political System As Would Provide For The Permanent Liberty And Happiness Of The United States.

I Own Myself The Friend To A Very Free System Of Commerce, And Hold It As A Truth, That Commercial Shackles Are Generally Unjust, Oppressive And Impolitic.

On The Distinctive Principles Of The Government ... Of The U. States, The Best Guides Are To Be Found In ... The Declaration Of Independence, As The Fundamental Act Of Union Of These States.

Where An Excess Of Power Prevails, Property Of No Sort Is Duly Respected. No Man Is Safe In His Opinions, His Person, His Faculties, Or His Possessions.

Every New Regulation Concerning Commerce Or Revenue; Or In Any Manner Affecting The Value Of The Different Species Of Property, Presents A New Harvest To Those Who Watch The Change And Can Trace Its Consequences; A Harvest Reared Not By Themselves But By The Toils And Cares Of The Great Body Of Their Fellow Citizens. This Is A State Of Things In Which It May Be Said With Some Truth That Laws Are Made For The Few Not For The Many.

A Republic, By Which I Mean A Government In Which The Scheme Of Representation Takes Place, Opens A Different Prospect And Promises The Cure For Which We Are Seeking.

There Is An Evil Which Ought To Be Guarded Against In The Indefinite Accumulation Of Property From The Capacity Of Holding It In Perpetuity By...corporations. The Power Of All Corporations Ought To Be Limited In This Respect. The Growing Wealth Acquired By Them Never Fails To Be A Source Of Abuses.

The Most That The Convention Could Do In Such A Situation, Was To Avoid The Errors Suggested By The Past Experience Of Other Countries, As Well As Of Our Own; And To Provide A Convenient Mode Of Rectifying Their Own Errors, As Future Experience May Unfold Them.

The Liberal Appropriations Made By The Legislature Of Kentucky For A General System Of Education Cannot Be Too Much Applauded . . . . Learned Institutions Ought To Be The Favorite Objects With Every Free People. They Throw That Light Over The Public Mind Which Is The Best Security Against Crafty And Dangerous Encroachments On The Public Liberty . . . . What Spectacle Can Be More Edifying Or More Seasonable Than That Of Liberty And Learning, Each Leaning On The Other For Their Mutual And Surest Support?

...freedom Arises From The Multiplicity Of Sects, Which Prevades America And Which Is The Best And Only Security For Religious Liberty In Any Society. For Where There Is Such A Variety Of Sects, There Cannot Be A Majority Of Any One Sect To Oppress And Persecute The Rest.

The Powers Delegated By The Proposed Constitution To The Federal Government Are Few And Defined. Those Which Are To Remain In The State Governments Are Numerous And Indefinite. The Former Will Be Exercised Principally On External Objects, As War, Peace, Negotiation And Foreign Commerce. ... Resistance To Tyranny Is Service To God.

I Wish Not To Be Regarded As An Advocate For The Particular Organizations Of The Several State Governments . . . They Carry Strong Marks Of The Haste, And Still Stronger Marks Of The Inexperience, Under Which They Were Framed.

Is The Appointment Of Chaplains To The Two Houses Of Congress Consistent With The Constitution, And With The Pure Principle Of Religious Freedom? In Strictness The Answer On Both Points Must Be In The Negative. The Constitution Of The U. S. Forbids Everything Like An Establishment Of A National Religion. The Law Appointing Chaplains Establishes A Religious Worship For The National Representatives, To Be Performed By Ministers Of Religion, Elected By A Majority Of Them, And These Are To Be Paid Out Of The National Taxes. Does This Not Involve The Principle Of A National Establishment ... ?

On Any Other Hypothesis, The Delegation Of Judicial Power Would Annul The Authority Delegating It; And The Concurrence Of This Department With The Others In Usurped Powers, Might Subvert Forever, And Beyond The Possible Reach Of Any Rightful Remedy, The Very Constitution Which All Were Instituted To Preserve.

[n]o Religious Test Shall Ever Be Required As A Qualification To Any Office Or Public Trust Under The United States.

Commercial Shackles Are Generally Unjust, Oppressive, And Impolitic.

[r]efusing Or Not Refusing To Execute A Law To Stamp It With Its Final Character . . . Makes The Judiciary Department Paramount In Fact To The Legislature, Which Was Never Intended And Can Never Be Proper.

There Is A Degree Of Depravity In Mankind Which Requires A Certain Degree Of Circumspection And Distrust.

If Tyranny And Oppression Come To This Land, It Will Be In The Guise Of Fighting A Foreign Enemy.

Stability In Government Is Essential To National Character And To The Advantages Annexed To It, As Well As To That Repose And Confidence In The Minds Of The People, Which Are Among The Chief Blessings Of Civil Society.

The Happy Union Of These States Is A Wonder; Their Constitution A Miracle; Their Example The Hope Of Liberty Throughout The World.

The Best Reason To Be Assigned, In This Case, For Not Having Made The Constitution More Free From A Charge Of Uncertainty In Its Meaning, Is Believed To Be, That It Was Not Suspected That Any Such Charge Would Ever Take Place; And It Appears That No Such Charge Did Take Place, During The Early Period Of The Constitution, When The Meaning Of Its Authors Could Be Best Ascertained, Nor Until Many Of The Contemporary Lights Had In The Lapse Of Time Been Extinguished. How Often Does It Happen, That A Notoriety Of Intention Diminishes The Caution Against Its Being Misunderstood Or Doubted!

I Regret, As Much As Any Member, The Unavoidable Weight And Duration Of The Burdens To Be Imposed; Having Never Been A Proselyte To The Doctrine, That Public Debts Are Public Benefits. I Consider Them, On The Contrary, As Evils Which Ought To Be Removed As Fast As Honor And Justice Will Permit.

It Becomes All Therefore Who Are Friends Of A Government Based On Free Principles To Reflect, That By Denying The Possibility Of A System Partly Federal And Partly Consolidated, And Who Would Convert Ours Into One Either Wholly Federal Or Wholly Consolidated, In Neither Of Which Forms Have Individual Rights, Public Order, And External Safety, Been All Duly Maintained, They Aim A Deadly Blow At The Last Hope Of True Liberty On The Face Of The Earth.

The Future And Success Of America Is Not In This Constitution, But In The Laws Of God Upon Which This Constitution Is Founded.

In Time Of Actual War, Great Discretionary Powers Are Constantly Given To The Executive Magistrate. Constant Apprehension Of War, Has The Same Tendency To Render The Head Too Large For The Body. A Standing Military Force, With An Overgrown Executive Will Not Long Be Safe Companions To Liberty.

The Advancement And Diffusion Of Knowledge Is The Only Guardian Of True Liberty.

Nor Is Any Evidence To Be Found, Either In History Or Human Nature, That Nations Are To Be Bribed Out Of A Spirit Of Encroachment And Aggression, By Humiliations Which Nourish Their Pride, Or By Concessions That Extend Their Resources And Power.

Our Opinions Agree As To The Evil, Moral, Political, And Economical, Of Slavery.

The Political Truths Declared In That Solemn Manner Acquire By Degrees The Character Of Fundamental Maxims Of Free Government, And As They Become Incorporated With National Sentiment, Counteract The Impulses Of Interest And Passion.

It Would Have Marked A Want Of Foresight In The Convention, Which Our Own Experience Would Have Rendered Inexcusable.

The Advice Nearest To My Heart And Deepest In My Convictions Is That The Union Of The States Be Cherished And Perpetuated. Let The Open Enemy To It Be Regarded As A Pandora With Her Box Opened, And The Disguised One As The Serpent Creeping With His Deadly Wiles Into Paradise.

Complaints Are Everywhere Heard From Our Most Considerate And Virtuous Citizens, Equally The Friends Of Public And Private Faith, And Of Public And Personal Liberty, That Our Governments Are Too Unstable, That The Public Good Is Disregarded In The Conflicts Of Rival Parties, And That Measures Are Too Often Decided, Not According To The Rules Of Justice And The Rights Of The Minor Party, But By The Superior Force Of An Interested And Overbearing Majority.

Like All Governments Free In Their Principles, Rests On Compact; A Compact, Not Between The Government & The Parties Who Formed & Live Under It; But Among The Parties Themselves, And The Strongest Of Governments Are Those In Which The Compacts Were Most Fairly Formed And Most Faithfully Executed.

The House Of Representatives ... Can Make No Law, Which Will Not Have Its Full Operation On Themselves And Their Friends, As Well As The Great Mass Of Society. This Has Always Been Deemed One Of The Strongest Bonds By Which Human Policy Can Connect The Rulers And The People Together. It Creates Between Them That Communion Of Interest, And Sympathy Of Sentiments, Of Which Few Governments Have Furnished Examples; But Without Which Every Government Degenerates Into Tyranny.

I Acknowledge, In The Ordinary Course Of Government, That The Exposition Of The Laws And Constitution Devolves Upon The Judicial. But I Beg To Know Upon What Principle It Can Be Contended That Any One Department Draws From The Constitution Greater Powers Than Another In Marking Out The Limits Of The Powers Of The Several Departments.

One Nation Is To Another What One Individual Is To Another; With This Melancholy Distinction Perhaps, That The Former With Fewer Of The Benevolent Emotions Than The Latter, Are Under Fewer Restraints Also From Taking Undue Advantage Of The Indiscretions Of Each Other.

With Respect To The Words "general Welfare," I Have Always Regarded Them As Qualified By The Detail Of Powers Connected With Them. To Take Them In A Literal And Unlimited Sense Would Be A Metamorphosis Of The Constitution Into A Character Which There Is A Host Of Proofs Was Not Contemplated By Its Creators.

There Is In Every Breast A Sensibility To Marks Of Honor, Of Favor, Of Esteem, And Of Confidence, Which, Apart From All Considerations Of Interest, Is Some Pledge For Grateful And Benevolent Returns. Ingratitude Is A Common Topic Of Declamation Against Human Nature; And It Must Be Confessed, That Instances Of It Are But Too Infrequent And Flagrant Both In Public And In Private Life. But The Universal And Extreme Indignation Which It Inspires, Is Itself A Proof Of The Energy And Prevalence Of The Contrary Sentiment.

The Two Great Points Of Difference Between A Democracy And A Republic Are: First, The Delegation Of The Government, In The Latter,to A Small Number Of Citizens Elected By The Rest; Secondly, The Greater Number Of Citizens And Greater Sphere Of Country Over Which The Latter May Be Extended.

Among The Features Peculiar To The Political System Of The United States Is The Perfect Equality Of Rights Which It Secures To Every Religious Sect. The Danger Of Silent Accumulations & Encroachments By Ecclesiastical Bodies Have Not Sufficiently Engaged Attention In The U.s. [...] Besides The Danger Of A Direct Mixture Of Religion & Civil Government, There Is An Evil Which Ought To Be Guarded Against In The Indefinite Accumulation Of Property From The Capacity Of Holding It In Perpetuity By Ecclesiastical Corporations. [...] The Establishment Of The Chaplainship To Congs. Is A Palpable Violation Of Equal Rights, As Well As Of Constitutional Principles.

Each State, In Ratifying The Constitution, Is Considered As A Sovereign Body, Independent Of All Others, And Only To Be Bound By Its Own Voluntary Act. In This Relation, Then, The New Constitution Will, If Established, Be A Federal, And Not A National Constitution.

The Express Authority Of The People Alone Could Give Validity To The Constitution.

If Congress Can Do Whatever In Their Discretion Can Be Done By Money, And Will Promote The General Welfare, The Government Is No Longer A Limited One, Possessing Enumerated Powers, But An Indefinite One.

We Maintain Therefore That In Matters Of Religion, No Man's Right Is Abridged By The Institution Of Civil Society, And That Religion Is Wholly Exempt From Its Cognizance.

In Civilized Communities, Property As Well As Personal Rights Is An Essential Object Of The Laws, Which Encourage Industry By Securing The Enjoyment Of Its Fruits; That Industry From Which Property Results, And That Enjoyment Which Consists Not Merely In Its Immediate Use, But In Its Posthumous Destination To Objects Of Choice, And Of Kindred Affection. In A Just And Free Government, Therefore, The Rights Both Of Property And Of Persons Ought To Be Effectually Guarded.

There Is Not A More Important And Fundamental Principle In Legislation, Than That The Ways And Means Ought Always To Face The Public Engagements; That Our Appropriations Should Ever Go Hand In Hand With Our Promises. To Say That The United States Should Be Answerable For Twenty-five Millions Of Dollars Without Knowing Whether The Ways And Means Can Be Provided, And Without Knowing Whether Those Who Are To Succeed Us Will Think With Us On The Subject, Would Be Rash And Unjustifiable. Sir, In My Opinion, It Would Be Hazarding The Public Faith In A Manner Contrary To Every Idea Of Prudence.

That Is Not A Just Government, Nor Is Property Secure Under It, Where The Property Which A Man Has In His Personal Safety And Personal Liberty, Is Violated By Arbitrary Seizures Of One Class Of Citizens For The Service Of The Rest.

I Think It Absolutely Necessary That The President Should Have The Power Of Removing His Subordinates From Office; It Will Make Him, In A Peculiar Manner, Responsible For Their Conduct, And Subject Him To Impeachment Himself, If He Suffers Them To Perpetrate With Impunity High Crimes Or Misdemeanors Against The United States, Or Neglects To Superintend Their Conduct, So As To Check Their Excesses.

A Just Security To Property Is Not Afforded By That Government, Under Which Unequal Taxes Oppress One Species Of Property And Reward Another Species.

It May Be Considered As An Objection Inherent In The Principle, That As Every Appeal To The People Would Carry An Implication Of Some Defect In The Government, Frequent Appeals Would In Great Measure Deprive The Government Of That Veneration Which Time Bestows On Every Thing, And Without Which Perhaps The Wisest And Freest Governments Would Not Possess The Requisite Stability . . . A Constitutional Road To The Decision Of The People Ought To Be Marked Out And Kept Open, For Certain Great And Extraordinary Occasions

It Is A Melancholy Reflection That Liberty Should Be Equally Exposed To Danger Whether The Government Have Too Much Power Or Too Little Power And That The Line Which Divides These Extremes Should Be So Inaccurately Defined By Experience.

A Dependence On The People Is, No Doubt, The Primary Control On The Government; But Experience Has Taught Mankind The Necessity Of Auxiliary Precautions.

We Have The Self-evident Right To Regulate Our Trade According To Our Own Will And Our Own Interest . . . . This Right Can Be Denied To No Independent Nation.

The Management Of Foreign Relations Appears To Be The Most Susceptible Of Abuse Of All The Trusts Committed To A Government, Because They Can Be Concealed Or Disclosed, Or Disclosed In Such Parts And At Such Times As Will Best Suit Particular Views; And Because The Body Of The People Are Less Capable Of Judging, And Are More Under The Influence Of Prejudices, On That Branch Of Their Affairs, Than Of Any Other. Perhaps It Is A Universal Truth That The Loss Of Liberty At Home Is To Be Charged To Provisions Against Danger, Real Or Pretended, From Abroad.

In All The Co-temporary Discussions And Comments, Which The Constitution Underwent, It Was Constantly Justified And Recommended On The Ground, That The Powers Not Given To The Government, Were Withheld From It.

An Armed And Trained Militia Is The Firmest Bulwark Of Republics - That Without Standing Armies Their Liberty Can Never Be In Danger, Nor With Large Ones Safe.

I Consider It…as Subverting The Fundamental And Characteristic Principle Of The Government…and As Bidding Defiance To The Sense In Which The Constitution Is Known To Have Been Proposed, Advocated, And Adopted. If Congress Can Do Whatever In Their Discretion Can Be Done By Money, And Will Promote The General Welfare, The Government Is No Longer A Limited One.

The Only Answer That Can Be Given Is, That As All These Exterior Provisions Are Found To Be Inadequate, The Defect Must Be Supplied, By So Contriving The Interior Structure Of The Government, As That Its Several Constituent Parts May, By Their Mutual Relations, Be The Means Of Keeping Each Other In Their Proper Places.

Congress Shall Never Disarm Any Citizen Unless Such As Are Or Have Been In Actual Rebellion.

If The People Are To Be Our Governors, They Must Arm Themselves With Knowledge.

Should Ardent Spirits Be Everywhere Banished From The List Of Drinks, It Will Be A Revolution Not The Least Remarkable In This Revolutionary Age, And Our Country Will Have Its Full Share In That As In Other Merits.

If This Spirit Shall Ever Be So Far Debased, As To Tolerate A Law Not Obligatory On The Legislature, As Well As On The People, The People Will Be Prepared To Tolerate Any Thing But Liberty.
